Notice of Pre-AIA or AIA Status
This is a first office action on the merits for application serail number 18/895,022 filed 9/24/24. Claims 1-20 are pending. The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
The information disclosure statement (IDS) submitted on 9/24/24 is mostly in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement has been considered by the examiner. No copies of any documents clearly discernable or identified as the three NPL citations were found. As such, they have been lined out and not considered for failing to comply with 37 CFR 1.98(a)(2), which requires a legible copy of each cited foreign patent document; each non-patent literature publication or that portion which caused it to be listed; and all other information or that portion which caused it to be listed.
The disclosure is objected to because of the following informalities: the third sentence of paragraph [0078] incudes type as it begins with “he”. It appears “he” should read - - The - -.
Appropriate correction is required.
The drawings are objected to because:
At least figures 2A-2C, 3C-3E, 11A-11, 14A-14B and 16-16A are too crowded. 37 CFR 1.84 (h) call for the view to be clearly separated and 37; CFR 1.84(i) recites the views must not be on the outlines of one another; and
The references numbers and line leads should not cross or mingle with the those of other views (37 CFR 1.84( p)(3)). See at least Figs 30/30E.
Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance.
The drawings are objected to as failing to comply with 37 CFR 1.84(p)(5) because they do not include the following reference sign(s) mentioned in the description: 121 and 222 of paragraph [0080]. Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Claims 1-10, 12-17 and 20 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Line 10 of claim 1, introduces “a first rung plate joined to a second rung plate”. The language is indefinite because lines 8-9 already define a second rung plate hingedly joined to the first rung plate.
In claim 2, “is” should be - -are - -.
Claim 3 recites “each of the first rung plate and rung plates has two opposed hinged edges” It is unclear how this further limits the recitation at lines 5-6 of claim 1 which already define each rung plate as having opposed hinges edges with hinges?
Claim 4 is indefinite because it introduces a second rung plate hingedly joined to a first rung plate but this already is define in claim 1 from which claim 4 depends. Further “vertically” should read - - vertical - -.
In claim 9, the language “one of the second rung plate and the second rung plate” is indefinite.
In claim 10, the language “wherein the second rung plate has a second rung plate width and the second rung plate has a second rung plate width” is indefinite.
In claim 12, it is not clear which hinge edge “the hinge edge” refences as each plate has been definite as having two opposed hinge edges. Further,, the language “the corresponding first rung plate or first run plate” is indefinite and “run plate” lacks antecedent basis.
In claim 20, “removable” should rad - -removably - -.
The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. Cir. 1985); In re Van Ornum, 686 F.2d 937, 214 USPQ 761 (CCPA 1982); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970); In re Thorington, 418 F.2d 528, 163 USPQ 644 (CCPA 1969).
A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on nonstatutory double patenting provided the reference application or patent either is shown to be commonly owned with the examined application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. See MPEP § 717.02 for applications subject to examination under the first inventor to file provisions of the AIA as explained in MPEP § 2159. See MPEP § 2146 et seq. for applications not subject to examination under the first inventor to file provisions of the AIA . A terminal disclaimer must be signed in compliance with 37 CFR 1.321(b).
The filing of a terminal disclaimer by itself is not a complete reply to a nonstatutory double patenting (NSDP) rejection. A complete reply requires that the terminal disclaimer be accompanied by a reply requesting reconsideration of the prior Office action. Even where the NSDP rejection is provisional the reply must be complete. See MPEP § 804, subsection I.B.1. For a reply to a non-final Office action, see 37 CFR 1.111(a). For a reply to final Office action, see 37 CFR 1.113(c). A request for reconsideration while not provided for in 37 CFR 1.113(c) may be filed after final for consideration. See MPEP §§ 706.07(e) and 714.13.

Although the claims at issue are not identical, they are not patentably distinct from each other because the subject matter of the instant claims is included within or obvious in view of the co-pending claims.
This is a provisional nonstatutory double patenting rejection because the patentably indistinct claims have not in fact been patented.

The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Note:
U.S. Patent 2,998,863 to Larson provides a suspension ladder comprise several hingedly connected sections 10 which may fold in a fanfold manner as shown in figure 6. Wall bearing members or “standoffs” 20 articulately connect the sections. An upper most section includes chains 44 for attaching and suspending the ladder. There in no suggestion of one and onkly one standoff or only a single point of contact with the wall.
U.S. Patent 4,613,013 to Watling which provides a suspension ladder comprised of hingedly connected generally planar plates 1 with openings 11 therein for accepting a user’s foot. A first or top plate having hooks 17 for suspending the ladder. There is no disclosure of only a single point of contact or of a standoff.
