Office Action

§112
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claims 1-8 are pending in the current application. Drawings The drawings are objected to because the view numbers of each of FIG. 2, FIG. 3a, and FIG. 3b, must be larger than the numbers used for reference characters. See 37 C.F.R. 1.84(u)(2). Additionally, the view numbers must be preceded by the abbreviation “FIG.” See 37 C.F.R. 1.84(u)(1). Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, Applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (B) CONCLUSION. - The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. Claims 1-8 are rejected under 35 U.S.C. 112(b) as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor regards as the invention. Specifically, Claim 1 is rejected since it is not clear what is meant by the language “magnetized in thickness” recited in line 4. Regarding Claim 1, each of lines 4 and 8, the acronym “N-S” is indefinite. Regarding Claim 4, line 7, the language “N pole” and the language “S pole” are not defined. Regarding Claim 6, each of the acronyms “XMR,” “TMR,” “AMR,” and “GMR” are indefinite. Regarding Claim 6, it is not clear what is meant by the language “reluctance unit” recited in line 2. Regarding Claim 7, line 7, the language “N pole” and the language “S pole” are not defined. Regarding Claim 8, line 7, the language “N pole” and the language “S pole” are not defined. Conclusion The prior art made of record and not relied upon is considered pertinent to Applicant's disclosure. Beurdeley et al. (U.S. Pat. Pub. No. 2023/0168706 A1) discloses a rocker device utilizing a ring magnet, magnet inside ring, and a magnetic sensor. However, Beurdeley and the prior art fail to teach, disclose, or suggest, either alone or in combination, a rocker device with an automatic center returning function, wherein the rocker device comprises: a ring magnet with a circular aperture, a fixed member, a magnet inside ring fixedly connected to the rocker, wherein a line connecting N-S poles is perpendicular to a circular section of the circular aperture, N-S poles of the magnet inside ring are completely symmetrical in shape, and arranged in a center of the circular aperture of the ring magnet, wherein when the rocker is in a state of having been rotated to return to a center, a line connecting the N-S poles of the magnet inside ring is perpendicular to the circular section of the circular aperture, as recited in Claim 1.
