Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Information Disclosure Statement
In the Information Disclosure Statement of November 25, 2025, the Japanese patent document was not considered because a clear copy (37 CFR § 1.98(a)(2); MPEP § 609.04(a)II) was not provided.
Specification
The disclosure is objected to because of the following informalities: In specification paragraph 0001, the status of the parent applications needs to be updated. On page 4, first line, “aperture size of aperture size” lacks proper grammatical syntax. In paragraph 0081, second to last line, “of with” lacks proper syntax. In paragraph 0082, fourth through sixth lines, the sentence enclosed by parentheses is incomplete. In paragraph 0088, sixth line, “capsular” is misspelled. In paragraph 0097, last line, “micrometer”, first occurrence, should be pluralized. In paragraph 0098, seventh line, Applicant may have meant “chafing” rather than “chaffing”. On page 24, the sentence on the third and fourth lines lacks proper syntax. In paragraph 0106, last line, “they” should read --the y--. In paragraph 0110, equations 4 and 5 are of improper format and should be revised to be similar to equations 2 and 3 in paragraphs 0102 and 0106, for example. In paragraph 0114, it is not understood why some of the “10”s are in boldface. In paragraphs 0115-0118, the number following each “a” should be subscripted (e.g., --a2--). In paragraph 0122, last line, “|k|.sub.x|” should be --kx--. In paragraph 0125, there are grammatical errors on the sixth through seventh lines and on the ninth line. In paragraph 0135, sixth line, “depth’s” is a misspelling, and on the eighth line, “along” should be --alone--. In paragraph 0142, third line, “measure” should be --measured--. In paragraph 0150, numerous “a” coefficients are of improper format. In paragraph 0155, the last sentence lacks proper syntax. The specification does not adequately describe Figures 9A-9B and 10 and the corresponding reference characters. Other grammatical errors were noted, and appropriate correction is required. No new matter should be entered.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
Claims 1-25 are rejected under 35 U.S.C. 112(b) as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor regards as the invention. In claim 1, last line, “the caustic” lacks a proper antecedent basis, and “may be” renders the claims vague and indefinite as to whether the last two lines impose limitations on the lens. In claims 5-9, the “a” coefficients should be subscripted rather than superscripted (e.g., page 24 of Applicant’s specification).
