Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Allowable Subject Matter Claims 13-20 are allowable Claims 1-7 and 8-12 are allowable, if 112 b rejection is overcome. Claim Objections Claims 1,8 and 13 are objected to because of the following informalities: -In claim 1 stated “transmitting the second, fourth, eighth, sixteenth, thirty-second, and sixty- fourth subcarriers over a transmission interval”, it should be “transmitting the second, fourth, eighth, sixteenth, thirty-second, and sixty- fourth subcarriers over the transmission interval”, the transmission interval is referred to “a transmission interval” cited in line 10 -The same rational is applied to the claims 8 and 13. Appropriate corrections are required. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION. —The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claim 1 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor, or for pre-AIA the applicant regards as the invention. -Claim 1 recites, the limitation " selecting the second, fourth, eighth, sixteenth, thirty-second, and sixty- fourth subcarriers in the orthogonal frequency division multiplexing bandwidth" in line 5. There is an insufficient antecedent basis for this limitation in the claim. The same problem should be rectified in the claim 8.
