DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-24 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Regrading claims 1-24, independent claims 1, 9 and 17 recite limitation “determining, based on the communication, a signal strength associated with the communication” which renders the claims indefinite for failing to particularly point out and distinctly claim the subject matter. What is “a signal strength associated with the communication”? signal strength of the signal (i.e. the communication), from the second computing device, being received/measured/determined by the first computing device? or signal strength of a signal, received/measured/determined by the second computing device in a first network or in a second network, being reported back to the first computing device in “the communication”? Further, independent claims 1, 9 and 17 recite limitation “determining, based on the signal strength, a reduced power level associated with a second wireless network; and causing transmission of one or more signals, associated with the second wireless network, at the reduced power level” which also renders the claims indefinite for failing to particularly point out and distinctly claim the subject matter. “Transmission of one or more signals” at a determined reduced power level is from which device to which device and in what network? from the first or second computing devices in the first network in order to reduce interference onto the second network? from the second computing device communicating in the second network? from other devices of the second network communicating with the second computing device as their access point or communicating with each other? Corrections and/or claim clarifications are required.
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
