Office Action

§102 §103
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim(s) 1, 7, 9, 10, and 12-15 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by McPherson (US 5,809,982), provided by applicant. McPherson (Figs 16-17) discloses a rotatable member arranged for use in an archery bow, the rotatable member comprising: a body (Fig 16) comprising a bowstring track and a non-circular cavity (55), the body comprising a first material; and a weight member attached to the body, the weight member comprising a non-circular shape, the weight member oriented in the non-circular cavity, the weight member comprising a second material different from the first material (see claim 4). Claim Rejections - 35 USC § 103 The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. Claim(s) 6 is/are rejected under 35 U.S.C. 103 as being unpatentable over McPherson (US 5,809,982). McPherson discloses the claimed invention except for the width of the weight member. Before the effective filing date of the claimed invention, it would have been an obvious matter of design choice to modify the width the weight member, since such a modification would have involved a mere change in the size of a component. A change in size is generally recognized as being within the level of ordinary skill in the art. In re Rose, 105 USPQ 237 (CCPA 1955). Further, in Gardner v. TEC Systems, Inc., 725 F.2d 1338, 220 USPQ 777 (Fed. Cir. 1984), cert. denied, 469 U.S. 830, 225 USPQ 232 (1984), the Federal Circuit held that, where the only difference between the prior art and the claims was a recitation of relative dimensions of the claimed device and a device having the claimed relative dimensions would not perform differently than the prior art device, the claimed device was not patentably distinct from the prior art device. Claim(s) 8 is/are rejected under 35 U.S.C. 103 as being unpatentable over McPherson (US 5,809,982) in view of McPherson (US 2020/0025504), hereinafter (“McPherson II”). McPherson discloses the claimed invention except for the second portion comprising raised flanges arranged to enlarge the bowstring track. McPherson II (Fig 3) teaches a body wherein a second portion comprising raised flanges. Before the effective filing date of the claimed invention, it would have been obvious for one of ordinary skill in the art to modify the body in McPherson to have the raised flanges of McPherson II for the obvious advantages of the raised flanges in McPherson II. All claimed elements were known in the prior art and one skilled in the art could have combined the elements as claimed by known methods with no change in their respective functions, and the combination would have yielded predictable results to a skilled artisan at the time the invention was made. Allowable Subject Matter Claims 2-5, 11, and 16 objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Claims 17 and 18 allowed. Conclusion THIS ACTION IS MADE FINAL. Applicant is reminded of the extension of time policy as set forth in 37 CFR 1.136(a). A shortened statutory period for reply to this final action is set to expire THREE MONTHS from the mailing date of this action. In the event a first reply is filed within TWO MONTHS of the mailing date of this final action and the advisory action is not mailed until after the end of the THREE-MONTH shortened statutory period, then the shortened statutory period will expire on the date the advisory action is mailed, and any nonprovisional extension fee (37 CFR 1.17(a)) pursuant to 37 CFR 1.136(a) will be calculated from the mailing date of the advisory action. In no event, however, will the statutory period for reply expire later than SIX MONTHS from the mailing date of this final action.
