Patentability shall not be negated by the manner in which the invention was made. The factual inquiries for establishing a background for determining obviousness under 35 U.S.C. 103 are summarized as follows: 1. Determining the scope and contents of the prior art. 2. Ascertaining the differences between the prior art and the claims at issue. 3. Resolving the level of ordinary skill in the pertinent art. 4. Considering objective evidence present in the application indicating obviousness or nonobviousness. This application currently names joint inventors. In considering patentability of the claims the examiner presumes that the subject matter of the various claims was commonly owned as of the effective filing date of the claimed invention(s) absent any evidence to the contrary. Applicant is advised of the obligation under 37 CFR 1.56 to point out the inventor and effective filing dates of each claim that was not commonly owned as of the effective filing date of the later invention in order for the examiner to consider the applicability of 35 U.S.C. 102(b)(2)(C) for any potential 35 U.S.C. 102(a)(2) prior art against the later invention. Claim 13 is rejected under 35 U.S.C. 103 as being unpatentable over Chisci et al in view of Raghavan et al (US 2023/0198584 A1). Claim 13. Chisci shows the method according to claim 8, wherein the first device is a terminal and the second device is a network-side device (fig. 2: UE 215a/b and base station 205a), and before the receiving, by a first device, a first signal and a second signal that are sent by a second device ([0094]: the wireless communication device may indicate, in beam coverage information, the signal energy threshold adjustment, and a network wireless communication device (e.g. BS, UE) may be configured to use the sensing beam pattern for channel sensing before transmitting in transmit beam direction, and apply the signal energy threshold adjustment indicated in the corresponding beam coverage information).Chisci does not expressly describe wherein the method further comprises at least one of the following: performing, by the first device, beam training or codebook feedback, so that a beam energy of the first signal is concentrated on a transmission channel meeting the first condition; or performing, by the first device, beam training or codebook feedback, so that a beam energy of the second signal is concentrated on a transmission channel meeting the second condition.Raghavan teaches feature of performing, by the first device, beam training or codebook feedback, so that a beam energy of the first signal is concentrated on a transmission channel meeting the first condition ([0097]: the information on analog beamforming codebook feedback includes an indication of a number of hierarchical levels present in a beamforming codebook, a number of beams in each hierarchical level of the hierarchical levels, an array gain variation across all beams in a first hierarchical level, and/or an overlap region between a first set of beams in one hierarchical level and a second set of beams in another hierarchical level); or performing, by the first device, beam training or codebook feedback, so that a beam energy of the second signal is concentrated on a transmission channel meeting the second condition ([0112]: the information on analog beamforming codebook feedback includes an indication of a number of hierarchical levels present in a beamforming codebook, a number of beams in each hierarchical level of the hierarchical levels, an array gain variation across all beams in a first hierarchical level, and/or an overlap region between a first set of beams in one hierarchical level and a second set of beams in another hierarchical level). It would have been obvious to one of ordinary skill in the art before the effective filing date of the claimed invention to implement the codebook feedback feature as taught by Raghavan in the method of Chisci to maximize data throughput and reliability in wireless communication systems.---------- ---------- ---------- Claim 14 is rejected under 35 U.S.C. 103 as being unpatentable over Chisci et al in view of Ly et al (US 2019/0044677 A1). Claim 14. Chisci shows the method according to claim 1; Chisci does not very expressly describe wherein the first signal and the second signal use different receive beams; or the first signal and the second signal are received using a broadcast beam; or the first signal and the second signal use a same receive beam.Ly teaches feature of a first signal and a second signal using different receive beams / being received using a broadcast beam (fig. 2 and [0085]: base station 105-a may be configured to utilize quasi co-located (QCL) antenna ports for transmission of more than one kind of signal, such as synchronization signals, broadcast signals, reference signals, or other signals… if a first signal is transmitted utilizing a first antenna port that is QCL with a second antenna port that is utilized to transmit a second signal, then the first signal and the second signal may be transmitted/received via the same transmit beam 205 and receive beam 210).It would have been obvious to one of ordinary skill in the art before the effective filing date of the claimed invention to apply the beam feature as taught by Ly to the first and second signals of Chisci to support positioning procedures. ========== ========== ========== Allowable Subject Matter Claims 8 and 9 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. ---------- ---------- ---------- Conclusion The prior art made of record is considered pertinent to applicant’s disclosure. 1. Aldana et al, US 12,585,008 B1: a method of detecting, by a first device, an ultra-wideband (UWB) signal received from a second device via a UWB antenna of the first device. 2. Aboul-Magd et al, US 2022/0322116 A1: a method comprises, by a communications device, receiving over a network interface a sensing request transmitted by a sensing initiator, the communications device measuring the received sensing request and determining a parameter of the received sensing request, and the communications device sending over the network interface an action frame to the sensing initiator. 3. Arp et al, US 2021/0239756 A1: a method for measuring a skew between a first clock signal and a second clock signal comprises using a skew sensor for measuring a quantitative skew between a second clock signal and a first clock signal, the skew sensor comprises at least two skew detectors, each skew detector detects a skew between two input signals, a first skew detector receives either the first clock signal or the second clock signal as first input signal and the other one of the first clock signal and the second clock signal delayed by a first delay difference induced by one or more delay elements as second input signal, and a second skew detector receives either the first clock signal or the second clock signal as first input signal and the other one of the first clock signal and the second clock signal optionally delayed by a second delay difference induced by one more delay elements, wherein the second delay difference is different from the first delay difference, as second input signal. 4. Kojima et al, US 2016/0105235 A1: a system for measuring a linewidth of an optical signal includes an optical sensor determining a set of measurements of the linewidth of the optical signal propagated over different distances.
