DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claims 1-15, 17-19, 23-24 are pending. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. Claim(s) 1-8, 14, 15, 17, 19, 23-24 is/are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Yuan et al. US 20240214854. Regarding claim 1, A method for preparing a serving-cell change procedure performed by a wireless device (UE, Figure 6), the method comprising: receiving, from a wireless communication node (base station, Figure 1, element 105), a cell measurement and measurement reporting configuration (the base station may transmit a CSI request to the UE requesting the CSI report including the non-serving cell beam report, the CSI request may indicate resources over which the UE is to transmit the CSI report including the non-serving cell beam report and may indicate a format or content for the CSI report, para. 0101-0102); performing a cell measurement based on the cell measurement and measurement reporting configuration to generate a cell measurement report associated with the cell measurement; and transmitting the cell measurement report in a cell measurement reporting message according to the cell measurement and measurement reporting configuration, the cell measurement reporting message comprising control message of layer-1 or layer-2 (the base station may transmit a CSI request to the UE requesting the CSI report including the non-serving cell beam report as a result of receiving the request, the CSI request may indicate resources over which the UE is to transmit the CSI report including the non-serving cell beam report and may indicate a format or content for the CSI report, para. 0101-0102, the UE transmits the non-serving cell beam report to the BS via a MAC-CE, para. 0093). Regarding claim 2, The method of claim 1, wherein: the layer-1 comprises a physical (PHY) layer; and the layer-2 comprises at least one of a Media Access Control (MAC) layer, a Radio Link Control (RLC) layer, or a Packets Data Convergence Protocol (PDCP) layer (the UE may transmit the non-serving cell beam report to the BS via a MAC-CE, para. 0093, the UE may transmit the non-serving cell beam report to the BS via uplink control information (UCI), para. 0094). Regarding claim 3, The method of claim 1, wherein transmitting the cell measurement report comprises reporting the cell measurement via a layer-1 Uplink Control Information (UCI) message or a layer-2 MAC Control Element (MAC CE) message (the UE may transmit the non-serving cell beam report to the BS via a MAC-CE, para. 0093, the UE may transmit the non-serving cell beam report to the BS via uplink control information (UCI), para. 0094). Regarding claim 4, The method of claim 3, wherein the cell measurement report comprises measurement results of a source serving cell for the wireless device and at least one or more neighboring cells of the source serving cell. Regarding claim 5, The method of claim 4, further comprising identifying, among a set of candidate neighboring cells of the source serving cell for the wireless device, one or more suitable neighboring serving cells from preforming the cell measurement, wherein the cell measurement report comprises physical cell information of the one or more suitable neighboring cells (the UE includes a beam index for each beam that is reported via the non-serving cell beam report and for each reported beam provides a measured beam quality, the UE includes a physical cell ID in the non-serving cell beam report and may report the measured beam quality for each indicated beam via a beam quality metric, para. 0092). Regarding claim 6, The method of claim 5, wherein: the cell measurement report further comprises beam information for the one or more suitable neighboring cells; and the beam information being provided to indicate one or more recommended beams in the one or more suitable neighboring cells for the serving-cell change procedure ((the UE includes a beam index for each beam that is reported via the non-serving cell beam report and for each reported beam provides a measured beam quality, the UE includes a physical cell ID in the non-serving cell beam report and may report the measured beam quality for each indicated beam via a beam quality metric, para. 0092). Regarding claim 7, The method of claim 4, wherein the cell measurement and measurement reporting configuration indicates to the wireless device a triggering event condition for transmitting the cell measurement report (the UE may transmit, to a base station, a request for resources over which to transmit a CSI report including a non-serving cell beam report as a result of detecting the event, the base station may transmit a CSI request to the UE requesting the CSI report including the non-serving cell beam report as a result of receiving the request, the CSI request may indicate resources over which the UE is to transmit the CSI report including the non-serving cell beam report and may indicate a format or content for the CSI report, para. 0101-0102). Regarding claim 8, The method of claim 7, wherein the triggering event condition for transmitting the cell measurement report comprises at least one of the following set of triggering event conditions: a first result of the cell measurement indicates that the source serving cell for the wireless device is continuously being at or below a first threshold measurement level during a first preconfigured measurement time period; a second result of the cell measurement indicates that at least one neighboring cell of the source serving cell for the wireless device is continuously being at or higher than a second threshold measurement level during a second preconfigured measurement time period; or a difference measurement result between the first result and the second result is continuously being at or above a cell measurement disparity threshold level (the UE may detect an event that triggers a UE-initiated non-serving cell beam report such as L1-based event and may be associated with beam measurements for a set of beams that are associated with one or more non-serving cells, the UE can detect that each beam of the set of beams is associated with a beam quality that fails to satisfy a quality threshold, if an average beam quality of the set of beams fails to satisfy a quality threshold, para. 0100). Regarding claim 14, The method of claim 8, wherein the first result or the second result comprises at least one of a Reference Signal Received Power (RSRP), a Signal to Interference and Noise Ratio (SINR), or a Reference Signal Received Quality (RSRQ) (the UE obtains and uses any metric associated with beam quality for selecting or determining whether to request resources for the non-serving cell beam report, the UE uses an L1-RSRP metric, an L3-RSRP metric, a signal-to-noise ratio (SNR), an interference metric for selecting or determining whether to request resources for the non-serving cell beam report, para. 0089). Regarding claim 15, The method of claim 8, wherein the first result and the second result each comprise a cell-level measurement result or a beam-level measurement result respectively associated with the source serving cell for the wireless device and the at least one neighboring cell of the source serving cell (the UE may detect an event that triggers a UE-initiated non-serving cell beam report such as L1-based event and may be associated with beam measurements for a set of beams that are associated with one or more non-serving cells, the UE can detect that each beam of the set of beams is associated with a beam quality that fails to satisfy a quality threshold, if an average beam quality of the set of beams fails to satisfy a quality threshold, para. 0100). Regarding claim 17, The method of claim 15, wherein the beam-level measurement result comprises measurement result associated with a predetermined number of best beams of the source serving cell for the wireless device or the at least one suitable neighboring cell of the source serving cell (the UE may detect an event that triggers a UE-initiated non-serving cell beam report such as L1-based event and may be associated with beam measurements for a set of beams that are associated with one or more non-serving cells, the UE can detect that each beam of the set of beams is associated with a beam quality that fails to satisfy a quality threshold, if an average beam quality of the set of beams fails to satisfy a quality threshold, para. 0100). Regarding claim 19, The method of claim 8, wherein transmitting the cell measurement report in the cell measurement reporting message comprises, when at least one of the set of triggering event conditions is met: transmitting a MAC CE message comprising the cell measurement report to the wireless communication node; or triggering the wireless device to transmit the cell measurement reporting message as a layer-1 Uplink Control Information (UCI)e to the wireless communication node (the UE transmits the non-serving cell beam report to the BS via a MAC-CE, para. 0093). Regarding claim 23, a wireless device comprising a processor (processor, Figure 6, element 640) and a memory (memory, element 630) , wherein the processor is configured to read computer code from the memory to cause the wireless device to: receive, from a wireless communication node (base station, Figure 1, element 105), a cell measurement and measurement reporting configuration (the base station may transmit a CSI request to the UE requesting the CSI report including the non-serving cell beam report, the CSI request may indicate resources over which the UE is to transmit the CSI report including the non-serving cell beam report and may indicate a format or content for the CSI report, para. 0101-0102), perform a cell measurement based on the cell measurement and measurement reporting configuration to generate a cell measurement report associated with the cell measurement; and transmit the cell measurement report in a cell measurement reporting message according to the cell measurement and measurement reporting configuration, the cell measurement reporting message comprising control message of layer-1 or layer-2 (the base station may transmit a CSI request to the UE requesting the CSI report including the non-serving cell beam report as a result of receiving the request, the CSI request may indicate resources over which the UE is to transmit the CSI report including the non-serving cell beam report and may indicate a format or content for the CSI report, para. 0101-0102, the UE transmits the non-serving cell beam report to the BS via a MAC-CE, para. 0093). Claims 1-4, 24 is rejected under the same rationale. Allowable Subject Matter Claims 9-13, 18 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Chiou US 20240064542 discloses performing a cell measurement that includes applying multiple measurement functions at an identical synchronization signal block or in a SSB-based Radio Resource Management (RRM) measurement timing configuration (SMTC) window. Mattam et al. US 20220110411discloses determining by User Equipment whether a measurement ID of a first neighboring cell and a measurement ID of a second neighboring cell are same and if the measurement ID of the first neighboring cell and the measurement ID of the second neighboring cell are different, the UE prioritizes sending of a measurement report of the first neighboring cell over a measurement report of the second neighboring cell to a serving cell.
