Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Drawings The drawings are objected to as failing to comply with 37 CFR 1.84(p)(5) because they do not include the following reference sign(s) mentioned in the description: In Figure 1 or Figure 2, a cavity 105 is not depicted. Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance. Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim(s) 1 and 2 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Martin (US 20120186016 A1). Regarding claim 1, Martin teaches A multi-layered pillow protector, comprising: a first panel (Martin: FIG. 2 [0036] top side 24 of the pillow case 20); a second panel that is perimetrically joined to the first panel (Martin: FIG. 1 [0035] pillow case 20 having a top 24 and a bottom 26 sleeping surface and a seam 28 there between) such that the inner surfaces of the first panel and the second panel define a cavity having a void volume configured for the disposal of a pillow from one side (Martin: FIG. 1 [0035] pillow case 20 having a top 24 and a bottom 26 sleeping surface and a seam 28 there between); a plurality of appended panels adjoined externally along one of the sides of the first panel and the second panel (Martin: FIG. 2 [0036] seam 28 provides a hinge from which the flaps 30, 40 and 50 may wrap around a side of the pillow 10 and pillow case 20) with the rest of the sides of each of the appended panels independently accessible to move to form a plurality of layers on the first panel and second panel (Martin: FIG. 2 [0048] A pillow case 20 with layered spare flaps 30, 40 and 50 as disclosed is configured to cover at least a portion of the pillow 10); wherein each of the plurality of appended panels can be interchangeably used as head resting surfaces by flipping over the first and second panels (Martin: FIG. 11b [0048] pillow case 20 with layered spare flaps 30, 40 and 50 as disclosed is configured to cover at least a portion of the pillow 10). Regarding claim 2, Martin teaches The multi-layered pillow protector, wherein the first panel and the second panel are composed of a fabric spun from bamboo, silk, satin, polyester, or cotton (Martin: FIG. 2 [0053] cotton, polyester, cotton-polyester, silk).
