Office Action

§102
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim(s) 1-4 and 7 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by US 2000/0145239 A1 to Yamaguchi et al. Re-claim 1, Yamaguchi et al. disclose a mount, the mount comprising: an inner pipe 1 coupled to a vehicle (at 100 and 82, as 82 is fixedly part of 100); an outer pipe 2 is disposed external to the inner pipe and is coupled to a vehicle component 102; a first insulator 3 is disposed between the inner pipe 1 and the outer pipe 2, the first insulator insulates vibration and stops in a first direction movement of the vehicle component (see stops 81) in an axial direction of the inner pipe; a second insulator 85 is disposed axially spaced from the first insulator 3, the second insulator stops a second direction of movement of the vehicle component occurring in the axial direction of the inner pipe (via stops 84) and a movement of the vehicle component occurring in a radial direction of the inner pipe. As shown in figure 1, the second insulator 85 is provided with an inwardly extending portion that will resist or stop radial movement of the inner pipe 1. Re-claim 2, the second insulator 85 is disposed on a plate 83 coupled to an end portion of the inner pipe, the second insulator is fixed by the plate at a position facing the first insulator with a predetermined gap therebetween. The plate 83 is fixed to a flange of 103 which is part of 102. An end portion is coupled to 102/103 and thus coupled to the second insulator. Re-claim 3, the first insulator 3 comprises: a bridge portion (central body portion) disposed between the inner pipe 1 and the outer pipe 2, the bridge portion is glued to an outer circumferential surface of the inner pipe and to an inner circumferential surface of the outer pipe (such as vulcanized, see paragraph 26); a first axial stopping portion 81 extends from a first end portion of the bridge portion and faces the vehicle body 82 with a predetermined gap therebetween. Re-claim 4, the bridge portion has a second end portion having a recessed groove. Re-claim 7, the outer pipe 2 has an end portion 51 with a support portion to support the first axial stopping portion 81 pressed by the vehicle body 100. Allowable Subject Matter Claims 5 and 6 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Hayashi, Niwa, Nakamura, Oniwa and Sato each teach a mount with a first and second insulator.
