DETAILED ACTION
Claim Rejections - 35 USC § 112
The following is a quotation of the first paragraph of 35 U.S.C. 112(a):
(a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention.
The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112:
The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention.
Claim 1-20 rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the enablement requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to enable one skilled in the art to which it pertains, or with which it is most nearly connected, to make and/or use the invention. Claim 1 states “for each first basis of the plurality of first bases, multiplying the corresponding first basis with a corresponding first basis coefficient, each first basis coefficient being used to determine a quantity of slots”, however the multiplying each first basis with a coefficient is not described in the specification. What is described in the specification para [0071] and fig. 6 shows multiplying each first basis type (e.g. b1, b2, b3, b4) with a coefficient. The examiner suggests the claims to state, “for each first basis type of the plurality of first bases, multiplying the corresponding first basis type with a corresponding first basis type coefficient, each first basis type coefficient being used to determine a quantity of slots”.
Claim 1 states that “each first basis type in the plurality of first bases indicates a quantity of slots of a corresponding first basis”. However, it is not clear how each first basis type (b1, b2, b3, b4) is indicating a quantity of slots. As seen in fig 4, the count of each first basis type indicates a number of slots.
Claims 2-20 are rejected with the same reasoning as claim 1.
