Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claim 1 rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Following are some of the 112 issues that claim 1 has:
The phrase "for example" renders the claim indefinite because it is unclear whether the limitation(s) following the phrase are part of the claimed invention. See MPEP § 2173.05(d).
Some of these “for examples” are recited as “e.g.”
(e.g., B1, B3, B8 for 4G networks in Vietnam)
(e.g., start, end, connected, lost connection)
“among others specific to the 4G network module”
The claim 1 is narrative in form and replete with indefinite language. The structure which goes to make up the device must be clearly and positively specified. The structure must be organized and correlated in such a manner as to present a complete operative device. The claim(s) must be in one sentence form only. Note the format of the claims in the patent(s) cited.
There should only be one period in the whole claim. However, this claim has two periods. There is one extra period in the middle of the claim right after the word “server”. This period must be deleted.
Furthermore, there are many instances of narrative limitations that should be amended to a proper claim language rather than spoken language. Languages such as “maybe” “should be” seems very tentative and not clear and thus not definitive. Limitations such as “Must be executed” “it is necessary” sounds more like a command rather than a proper claim language. The following limitation inside parenthesis seems to be explanations rather than actual limitations:
“(which may be based on ARM or RISC-V architecture)”
“will then send “AT” commands”
“receiving an “OK” response”
“(e.g., B1, B3, B8 for 4G networks in Vietnam)”
“among others specific to the 4G network module”
"the 4G network module should be able to connect to the network".
“these tasks must be executed concurrently (not sequentially, before task execution, it is necessary to declare, configure, and initialize task parameters,
including stack memory, priority levels, and core allocation (for multi-core microcontrollers);”
“each task must execute a series of sequential processes, which will be described in detail in the subsequent section.”
There is no clear connection between the initial phrase for each step and what follows. It is not clear whether the sub-steps that follow the labeled Steps 1, Step 2, Step 3 or Step 4 are actual steps or they are just simply explanation of the labeled Steps. For example, in step 3, is the "Initiate Tasks" the same as the two primary tasks that follow.
The claim is replete with 112 issues that make it difficult to determine the scope of the claim. Therefore, there was no art rejection since it was difficult to determine the metes and bounds of the claim.
Citation of Prior Art
The prior art made of record and not relied upon is considered pertinent to applicant’s disclosure.
Wei (US 11290931) teaches “a PositioningConfiguration information element comprises an information element RTK_GNNS that indicates that the source eNB uses RTK GNSS as positioning scheme” (Col 10; Lines 39-42), see also Fig. 4B.
Zhang (CN218917649) teaches “external 4G/5G wireless communication module
help realize the RTK implementation of the information acquisition part, send the NMEA-0183 standard protocol positioning information acquired by the RTK module to the RTK server, and receive the RTCM data transmission from the server to the receiver for high-precision positioning calculation; local transmission of positioning information is performed through the network interface (TCP/UDP/Telnet) and serial port interface; the data upload and interaction function of the MQTT protocol is configured, and the high-precision receiver can upload the positioning information to the MQTT server for real-time location monitoring through the network interface or the external 4G/5G communication module, and configure various values of the connected receiver by sending MQTT protocol messages through the MQTT server. At the same time, it can also cooperate with the FTP server to remotely upgrade and restart the high-precision receiver software.” (see n0017)
