Office Action

§101 §DP
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application is being examined under the pre-AIA first to invent provisions. Information Disclosure Statement The information disclosure statement (IDS) was filed with the application on 10/28/2024. The submission is in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement is being considered by the examiner. Double Patenting A rejection based on double patenting of the “same invention” type finds its support in the language of 35 U.S.C. 101 which states that “whoever invents or discovers any new and useful process... may obtain a patent therefor...” (Emphasis added). Thus, the term “same invention,” in this context, means an invention drawn to identical subject matter. See Miller v. Eagle Mfg. Co., 151 U.S. 186 (1894); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970); In re Ockert, 245 F.2d 467, 114 USPQ 330 (CCPA 1957). A statutory type (35 U.S.C. 101) double patenting rejection can be overcome by canceling or amending the claims that are directed to the same invention so they are no longer coextensive in scope. The filing of a terminal disclaimer cannot overcome a double patenting rejection based upon 35 U.S.C. 101. Claim 1 is rejected under 35 U.S.C. 101 as claiming the same invention as that of claim 1 of prior U.S. Patent No. 12,132,992. This is a statutory double patenting rejection. Application 18/929275 US Patent # 12,132,992 (Ozluturk) 1. A method of capturing stabilized digital video in a digital imaging device, the method comprising: displaying a preview of a subject within a field of view of the imaging device in a user interface of the imaging device capturing a digital video with an image sensor and a lens, wherein the video comprises a sequence of images; detecting a motion of the imaging device while capturing the digital video using one or more motion sensors and generating a motion information at least in part based on the output of the motion sensors; detecting the subject in one or more images of the sequence of images, and detecting a location of the subject within the images; obtaining a stabilized video by: determining shift amounts for the sequence of images of the video taking into account both the motion information and the location of the subject within the images; obtaining a sequence of modified images by modifying the sequence of images of the video based at least in part on the shift amounts determined; and combining the modified images to obtain a stabilized video; storing the stabilized video in a memory of the imaging device; and displaying the stabilized video in the user interface of the imaging device. 1. A method of capturing stabilized digital video in a digital imaging device, the method comprising: displaying a preview of a subject within a field of view of the imaging device in a user interface of the imaging device; capturing a digital video with an image sensor and a lens, wherein the video comprises a sequence of images; detecting a motion of the imaging device while capturing the digital video using one or more motion sensors and generating a motion information at least in part based on the output of the motion sensors; detecting the subject in one or more images of the sequence of images, and detecting a location of the subject within the images; obtaining a stabilized video by: determining shift amounts for the sequence of images of the video taking into account both the motion information and the location of the subject within the images; obtaining a sequence of modified images by modifying the sequence of images of the video based at least in part on the shift amounts determined; and combining the modified images to obtain a stabilized video; storing the stabilized video in a memory of the imaging device; and displaying the stabilized video in the user interface of the imaging device.
