Double Patenting
The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on nonstatutory double patenting provided the reference application or patent either is shown to be commonly owned with the examined application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. Claims 1-20 are rejected on the ground of nonstatutory double patenting as being unpatentable over claims 1-16 of U.S. Patent No. 9,838,187. Although the claims at issue are not identical, they are not patentably distinct from each other because of the mapping below:
As to claim 1, ‘187 teaches an integrated circuit for controlling a communication apparatus, comprising:: receiving circuitry which, in operation, receives configuration information for receiving, in subframe N in an uplink, at least one of a channel quality information report or a sounding reference symbol, and transmits a media access control (MAC) control element regarding a discontinuous reception (DRX) operation, wherein the MAC control element transmitted until and including subframe N-(4+k) is used to determine whether a user equipment will be in DRX Active Time or DRX Non-Active Time in subframe N, where k is an integer value equal to or greater than 1, and a transmitter which, in operation, does not transmit the channel quality information report or the sounding reference symbol in subframe N, in case the user equipment is determined to be not in DRX Active Time in subframe N (‘187, Claim 1).
‘187 does not explicitly teach transmitting circuitry for transmitting configuration information and a receiver which does not receive.
However, it would have been obvious to one of ordinary skill in the art to have the transmitter transmitting configuration information and a receiver which does not receive because they are elements at the recipient/transmitting end which are implied in the steps of ‘187.
As to claim 2, ‘187 teaches which is configured to receive at least one of the channel quality information report or the sounding reference symbol periodically (‘187, Claim 2).
As to claim 3, ‘187 teaches wherein at least one of uplink resource grants for an uplink shared channel or downlink resource assignments for a downlink shared channel, which are transmitted by the communication apparatus until and including subframe N-(4+k), are additionally used to determine whether the user equipment will be in DRX Active Time or DRX Non-Active Time in subframe N (‘187, Claim 3).
As to claim 4, ‘187 teaches wherein the receiver, in operation, receives at least one of the channel quality information report or the sounding reference symbol in subframe N, in case the user equipment is determined to be in DRX Active Time in subframe N (‘187, Claim 4).
As to claim 5, ‘187 teaches wherein DRX-related timers running for the user equipment including at least one of a DRX Inactivity Timer, a DRX OnDuration Timer, or a DRX Retransmission Timer, are additionally used to determine whether the user equipment will be in DRX Active Time or DRX Non-Active Time in subframe N (‘187, Claim 5).

As to claim 11, ‘725 teaches The process according to claim 9, wherein at least one of uplink resource grants for an uplink shared channel or downlink resource assignments for a downlink shared channel, which are transmitted by the communication apparatus until and including subframe N-(4+k), are additionally used to determine whether the user equipment will be in DRX Active Time or DRX Non-Active Time in subframe N. (‘725, Claim 11).
As to claim 12, ‘725 teaches The process according to claim 9, comprising: receiving at least one of the channel quality information report or the sounding reference symbol in subframe N, in case the user equipment is determined to be in DRX Active Time in subframe N. (‘725, Claim 12).
As to claim 13, ‘725 teaches The process according to claim 9, wherein DRX-related timers running for the user equipment including at least one of a DRX Inactivity Timer, a DRX OnDuration Timer, or a DRX Retransmission Timer, are additionally used to determine whether the user equipment will be in DRX Active Time or DRX Non-Active Time in subframe N. As to claim 14, ‘725 teaches The process according to claim 9, wherein radio resource control (RRC) signaling restricts periodic transmission of channel quality information reports to only during the DRX Active Time. (‘725, Claim 14).
As to claim 15, ‘725 teaches The process according to claim 9, wherein any MAC control element regarding a DRX operation in subframes N-(3+k) to N is disregarded by the user equipment. (‘725, Claim 15).

As to claim 17, ‘725 teaches A non-transitory computer-readable medium having contents which cause processing circuitry to perform a method, the method comprising: transmitting configuration information for receiving, in subframe N in an uplink, at least one of a channel quality information report or a sounding reference symbol, and transmitting a media access control (MAC) control element regarding a discontinuous reception (DRX) operation, wherein the MAC control element transmitted until and including subframe N-(4+k) is used to determine whether a user equipment will be in DRX Active Time or DRX Non-Active Time in subframe N, where k is an integer value equal to or greater than 1, and wherein the channel quality information report or the sounding reference symbol is not received in subframe N, in case the user equipment is determined to be not in DRX Active Time in subframe N. (‘725, Claim 1).
As to claim 18, ‘725 teaches The non-transitory computer-readable medium according to claim 17, wherein the contents cause the processing circuitry to perform: receiving at least one of the channel quality information report or the sounding reference symbol periodically. (‘725, Claim 2).

Claims 1-20 are allowable over prior art since the prior art taken individually or in combination fails to particularly disclose, fairly suggests, or render obvious the following limitations:
In claim 1, … transmitting configuration information for receiving, in subframe N in an uplink, at least one of a channel quality information report or a sounding reference symbol, and transmitting a media access control (MAC) control element regarding a discontinuous reception (DRX) operation, wherein the MAC control element transmitted until and including subframe N-(4+k) is used to determine whether a user equipment will be in DRX Active Time or DRX Non-Active Time in subframe N, where k is an integer value equal to or greater than 1, and wherein the channel quality information report or the sounding reference symbol is not received in subframe N, in case the user equipment is determined to be not in DRX Active Time in subframe N..…in combination with other limitations recited as specified in Claim 1.
The first closest prior art of record is 3GPP TSG RAN WG2 Meeting #81 36.321 CR 0629 (as disclosed in the IDS), herein 3GPP. 3GPP teaches a method for configuring a DRX cycle. 3GPP teaches for each subframe based on if a DRX command MAC control element is received adjusting a DRX timer. 3GPP further teaches that a CQI report not be reported if the UE is not in Active Time according to
grants/assignments/ MAC CE received until and including subframe n-4. 3GPP does not teach the italicized limitations above.
The second closest prior art of record is Mahmoud et al (Patent No: 9,125,209), herein Mahmoud. Mahmoud discloses a system for a periodic CQI report starting at the first subframe n by including subframe n-4, and based on the last subframe of a previous DRX cycle active time. Mahmoud fails to disclose the italicized limitations above.
