Claim Objections
Claim 9 is objected to because of the following informalities:
In claim 9, line 11, “road” is a typo and should be “load”. Appropriate correction is required.
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim 9 is rejected under 35 U.S.C. 102(a)(1) as being anticipated by Fang et al (“Bending Study of Submarine Power Cables based on a Repeated Unit Cell Model”, hereafter Fang).
Fang teaches the apparatus (Section 3 and 3.1-3.2, Figs 14-15, 18), the apparatus comprising: a pair of supports supporting at least one of a lower surface of two ends of a specimen or a lateral portion of the two ends (Figs 15, 18);
a pressurizer configured to apply a load to an upper surface of the specimen (Figs 15, 18); and a sensor configured to measure a displacement by which the specimen is deformed by the load (Section 3.2, “three displacement sensors” ),
wherein the specimen includes: a conductive material; and an insulating material with which a surface of the conductive material is coated (Fig. 1), and the apparatus includes a four-point bending test apparatus (Fig. 14) with two application points in which the road is applied to the upper surface of the specimen (Figs. 14, 15, 18.)
The preamble, “for measuring an elastic modulus” is considered intended use and is not given patentable weight.
Allowable Subject Matter
The following is a statement of reasons for the indication of allowable subject matter:
As per claim 1, prior art of record does not teach a third calculation operation of calculating an elastic modulus of the conductive material and an elastic modulus of the insulating material based on the calculated first bending elastic modulus and the calculated second bending elastic modulus.
Claim 10 is objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
Shimizu et al, WO 2022210684 A1, teaches a three-point bending test with a rectangular insulated cable.
Finot et al, US Patent 5847283, teaches determined Young’s modulus with multilayered sample in a four-point bending test.
