Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 112
The following is a quotation of the first paragraph of 35 U.S.C. 112(a):
(a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention.
The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112:
The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention.
Claim 1 is rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, because the specification, while being enabling for “a height of the outer wall of the conductive barrel 13 being lower than the height of the second insulating cylinder 14”, does not reasonably provide enablement for “an outer wall of the conductive barrel being higher than a height of the second insulating cylinder”, as claimed. The specification does not enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make the invention commensurate in scope with these claims.
Claim 1, lines 19-22, recites “the second insulating cylinder is inserted into the conductive barrel, and a bottom surface of the second insulating cylinder against an inner bottom surface of the conductive barrel, and an outer wall of the conductive barrel is higher than a height of the second insulating cylinder”.
However, paragraph 44 of applicant’s specification discloses that “a second insulating cylinder 14 is inserted into the conductive barrel 13, a height of the outer wall of the conductive barrel 13 is lower than the height of the second insulating cylinder 14, to prevent the formation of an electrically isolated layer at the opening of the reactor 1 (as shown in figure 2).
Appropriate correction and/or clarification are required.
Statement of Status of Claims - Allowable Subject Matter
Claims 2, 3, 5 and 11-18 are objected to as being dependent upon a rejected base claim but would be allowable if the rejection under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph is overcome.
Claims 1-3, 5 and 11-18 are free of rejection over prior art. The closest prior art is considered to be CN 109853001 to Kamali and US 2021/0009415 to Kamali, as previously presented.
Note that the claims are subject to a rejection under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, and therefore not indicated as allowable.
Conclusion
THIS ACTION IS MADE FINAL. Applicant is reminded of the extension of time policy as set forth in 37 CFR 1.136(a).
A shortened statutory period for reply to this final action is set to expire THREE MONTHS from the mailing date of this action.
