Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claim 1-20 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 1 recites “determining ... at least one change in the set of frames based on comparing the set of actions and the dialogue to a previous set of actions and a previous dialogue of a previous set of frames of the media stream.” However, the recited comparison is unclear. It is unclear whether the claim requires separately comparing the set of actions to the previous set of actions and the dialogue to the previous dialogue, collectively comparing the set of actions and dialogue with the previous set of actions and previous dialogue, or determining whether either the actions or the dialogue has changed.
This distinction matters since the block 409 in FIG. 4 recites “determine whether material change in action information or dialogue occurred?”
Additionally, it is unclear how the results of the recited comparison establish “at least one change in the set of frames.” The claim does not clearly specify whether the change refers to a change in the correlated action and dialogue information or physical change within the frames. The plain language of the claim requires a “change in the set of frames,” which implies an analysis of the raw video frame data.
The specification and drawings describe evaluating a change in the “correlated action and dialogue information”, not the raw video frames themselves. Please refer “[0066] The identified action and similar context information is correlated with the dialogue information (Block 407). The correlated information is checked to determine whether there is a change relative to previously processed frames (Block 409).” in the specification and the blocks 407 & 409 in FIG. 4.
With respect to claim 10, arguments analogous to those presented for claim 1, are applicable.
With respect to claim 19, arguments analogous to those presented for claim 1, are applicable.
Allowable Subject Matter
Claims 1-20 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action.
