Making Final
Applicant's arguments filed 4/28/2026 have been fully considered but they are moot in view of the new grounds for rejection.
The claim amendments regarding -- ‘a second cloud service by the cloud service provider’ -- clearly change the literal scope of the independent and dependent claims and/or the range of equivalents for such claims. The said amendments alter the scope of the claims but do not overcome the disclosure by the prior art as shown below.
The Examiner is presenting new grounds for rejection as necessitated by the claim amendments and is thus making this action FINAL.
Response to Arguments
Applicant's arguments filed 4/28/2026 have been fully considered but they are moot in view of the new grounds for rejection.
Kulkarni disclosed (re. Claim 1) wherein the first set of functions is provided as a first cloud service by a cloud service provider (Kulkarni-Paragraph 177, data intake and query system 108 can be…cloud-based service)
While Kulkarni substantially disclosed the claimed invention Kulkarni does not disclose (re. Claim 1) a second cloud service by the cloud service provider.
Ead Figure 7,Paragraph 168 disclosed a first cloud services provider (e.g., OCI) 710 and a second cloud environment provided by a second cloud services provider 720 (e.g., AWS). The first cloud environment 710 includes a multi-cloud infrastructure that provisions for capabilities to deliver services of the first cloud environment to users of other cloud environments (e.g., the second cloud environment 720).
Ead disclosed (re. Claim 1) a second cloud service by the cloud service provider.(Ead-Figure 7,Paragraph 168,a first cloud services provider (e.g., OCI) 710 and a second cloud environment provided by a second cloud services provider 720 (e.g., AWS). The first cloud environment 710 includes a multi-cloud infrastructure that provisions for capabilities to deliver services of the first cloud environment to users of other cloud environments (e.g., the second cloud environment 720).)
Kulkarni and Ead are analogous art because they present concepts and practices regarding cloud monitoring services. Before the time of the effective filing date of the claimed invention it would have been obvious to combine Ead into Kulkarni. The motivation for the said combination would have been to enable a user experience as close as possible to that of the native cloud environments of the users (e.g., the second cloud environment 720), while providing simple integration between the cloud environments.(Ead-Paragraph 169)
Kulkarni-Ead disclosed (re. Claim 1) wherein the second set of functions is provided as a second cloud service by the cloud service provider, (Ead-Figure 7,Paragraph 168,a first cloud services provider (e.g., OCI) 710 and a second cloud environment provided by a second cloud services provider 720 (e.g., AWS). The first cloud environment 710 includes a multi-cloud infrastructure that provisions for capabilities to deliver services of the first cloud environment to users of other cloud environments (e.g., the second cloud environment 720).) wherein the first cloud service and the second cloud service are services that can be subscribed to by one or more customers of the cloud service provider.(Kulkarni-Paragraph 177, a user may pay a subscription or other fee to use such a service. Each subscribing user of the cloud-based service)
Priority
The effective date of the claims described in this application is November 8, 2024.
Claim Rejections - 35 USC § 103
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
Claim(s) 1-5,7-12,14-19 is/are rejected under 35 U.S.C. 103 as being unpatentable over Kulkarni (USPGPUB 2023/0385288) further in view of Ead (USPGPUB 2024/0129285)
