Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claim 2 recites the limitation "the phrase" in line 2. There is insufficient antecedent basis for this limitation in the claim.
Claim 3 recites the limitation "the phrase" in line 2. There is insufficient antecedent basis for this limitation in the claim.
Claim 6 recites the limitation "the target field" in lines 1 and 3. There is insufficient antecedent basis for this limitation in the claim.
Claim 19 recites the limitation "the phrase" in line 10. There is insufficient antecedent basis for this limitation in the claim.
Allowable Subject Matter
Claims 1, 4-5, 7-18, and 20 are allowed.
Claim 19 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action.
Claims 2-3, and 6 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action and to include all of the limitations of the base claim and any intervening claims.
The following is an examiner’s statement of reasons for allowance: in accordance with MPEP 1302.14, the Examiner is of the opinion the claim set filed by the Applicant is allowable over the prior art of record. Please see the explanations of the closest prior art below for additional evidence of the reasons for allowance in order to satisfy the record as a whole. Examiner notes a completed search of the available patent literature and non-patent literature has been conducted by the Examiner and none of the cited references below (which has been found to be the closest prior art) either suggest or disclose, the claimed subject matter as a whole alone or in any reasonable combination.
Examiner notes U.S. Pub. No. 20240406846 to Wu et al. teaches receiving a first message in RRC inactive state, the first message comprising a first identifier, the first identifier being associated to the first node (par. 0080, teaches the UE 102 can determine whether the UL data for transmission during EDT qualifies for transmission in the inactive state in view of whether the UL data is associated with a radio bearer (e.g., DRB or SRB)), but does not disclose the action of setting a first field in the second message and determining whether each radio bearer in a first radio bearer set is to be resumed according to at least whether the first message indicates that the first node performs data transmission in the RRC inactive state.
Examiner notes U.S. Pub. No. 20230075866 to Kim et al. teaches receiving a first message in RRC inactive state, the first message comprising a first identifier, the first identifier being associated to the first node…and performing data transmission in the RRC inactive state (fig. 2B and par. 0166, teaches the terminal may receive a downlink control message from the base station through the SRB1 and transmit uplink data of the radio bearer (or data transmission in the INACTIVE state)), but does not disclose the action of setting a first field in the second message and determining whether each radio bearer in a first radio bearer set is to be resumed according to at least whether the first message indicates that the first node performs data transmission in the RRC inactive state.
Examiner notes U.S. Pub. No. 20220007423 to Agiwal et al. teaches determining whether each radio bearer in a first radio bearer set is to be resumed according to at least whether the first message indicates that the first node performs data transmission in the RRC inactive state (par. 0138, teaches the UE continues to remain in RRC_INACTIVE state and the user data transmitted/received in between reception of contention resolution identity and reception of RRCRelease message are ciphered and integrity protected (only for DRBs configured with UP integrity protection)), but does not disclose the action of setting a first field in the second message and determining whether each radio bearer in a first radio bearer set is to be resumed according to at least whether the first message indicates that the first node performs data transmission in the RRC inactive state.
