Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Specification
Applicant is reminded of the proper language and format for an abstract of the disclosure.
The abstract should be in narrative form and generally limited to a single paragraph on a separate sheet within the range of 50 to 150 words in length.
Claim Objections
The claims are objected to because of the following informalities:
Claim 6 recites “a tooth” in ln. 3-4, this is the second recitation of “a tooth” in the dependency chain of this claim. This second recitation does not render the claim indefinite as it would be understood by one of ordinary skill in the art that this would be one of the teeth of the toothing recited in claim 4. However, the examiner recommends changing “a tooth” to “the tooth” to provide clarity in claim 6.
Appropriate correction is required.
Claim Interpretation
The term “distant” as used in claim 1 is being interpreted by the examiner to mean “separated in space” in accordance with the principles of Broadest Reasonable Interpretation (BRI).
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-15 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 1 recites the limitation "the side of its second end" in ln. 13 and "the second direction" in ln. 18. There is insufficient antecedent basis for these limitations in the claim.
The term “useful” in claim 4 is a relative term which renders the claim indefinite. The term “useful” is not defined by the claim, the specification does not provide a standard for ascertaining the requisite degree, and one of ordinary skill in the art would not be reasonably apprised of the scope of the invention.
Claim 6 recites the limitation "the most part of the spring" in ln. 4. There is insufficient antecedent basis for this limitation in the claim. A suggested wording to overcome this rejection is “a majority of the spring”.
Claim 9 recites the limitation "the side of its second end”" in ln. 3. There is insufficient antecedent basis for this limitation in the claim.
Allowable Subject Matter
Claim 1 appears to be allowable if rewritten or amended to overcome the objections and rejections under 35 U.S.C. 112 set forth in this Office action.
