Claims 1-22 are presented for examination.
Claim Rejections - 35 USC § 112
The following is a quotation of the first paragraph of 35 U.S.C. 112(a):
(a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention.
The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112:
The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention.
Claims 1-22 are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the written description requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of the claimed invention.
The new claims 19-22 in this instant application claim the bold underlined instant elements of ”19. An information processing apparatus that communicates with an access point that performs communication conforming to Institute of Electrical and Electronics Engineers (IEEE) 802.11 series standard using an Orthogonal Frequency Division Multiple Access (OFDMA) scheme, the information processing apparatus comprising: at least one memory that stores a set of instructions; and at least one processing circuit, wherein the information processing apparatus is caused, by the at least one processing circuit executing the set of instructions, to perform and/or the at least one processing circuit itself performs operations comprising: determining whether to cause the access point and a plurality of station apparatuses to perform simultaneous uplink communication therebetween; and transmitting, to the access point, a communication parameter to be used for the simultaneous uplink communication in a case where it is determined to cause the access point and the plurality of station apparatuses to perform the simultaneous uplink communication therebetween, wherein information corresponding to the communication parameter transmitted to the access point is transmitted to the plurality of station apparatuses via the access point”; the instant published [29], [87] describes the elements of “[29], A storage unit 201 in the communication device 101 is constituted by a memory such as a ROM or a RAM and stores programs for performing various operations described below and various types of information such as communication parameters for wireless communication”; and “[87], Any other information processing device different from the base station 110 may determine communication devices that perform communication at the same timing by the base station 110, on the basis of a transmission request from each communication device, allocate an RU to each of the communication devices, and further determine the transmission power. In this case, the content of the determination is transmitted to the communication devices via the base station 110” in which is, the Base Station 110 = the Access Point described as in (Figure 1, A Base Station 110 is an Access Point …, [21]). Then the described [87] element of “Any other information processing device different from the base station 110 may determine communication devices that perform communication at the same timing by the base station 110, on the basis of a transmission request from each communication device, allocate an RU to each of the communication devices, and further determine the transmission power. In this case, the content of the determination is transmitted to the communication devices via the base station 110” is NOT equivalent to the bold underlined instant claimed elements in instant independent claim 19.
No indication in instant [29], [87] originally describe the technical feature of “transmitting, to the Access Point, a communication parameter to be used for the simultaneous uplink communication…”.
Therefore, the new claims 19-22 are not originally described in the instant paragraphs [29] and [87].
Claims 17, 14-15 are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the written description requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of the claimed invention.
The new independent claim 17 in this instant application claims the bold underlined instant elements of ”17. A communication apparatus that performs communication conforming to Institute of Electrical and Electronics Engineers (IEEE) 802.11 series standard using an Orthogonal Frequency Division Multiple Access (OFDMA) scheme, the communication apparatus comprising: at least one memory that stores a set of instructions; and at least one processing circuit, wherein the communication apparatus is caused, by the at least one processing circuit executing the set of instructions, to perform and/or the at least one processing circuit itself performs operations comprising: receiving, from an access point, a trigger frame that includes information about an association relationship of a plurality of resource units obtained by dividing a channel with a predetermined frequency bandwidth and Association Identifiers (AIDs) that are identification information of a plurality of communication apparatuses; performing measurement processing to measure a radio intensity in the channel including a resource unit associated with an AID of the communication apparatus in the trigger frame; and performing transmission control to transmit data to the access point using the resource unit associated with the AID of the communication apparatus in a case where a radio intensity to be measured in the measurement processing satisfies a predetermined condition, wherein, in the transmission control, an offset power value to be added to adjust power to a specified value is derived based on at least a radio intensity to be measure in the measurement processing, and the data is transmitted using power with the derived offset power value added thereto”.
Nowhere in instant Figures nor paragraphs in instant specification can describe new bold underlined elements in independent claim 17 equivalently.
Therefore, the new independent claim 17 is not originally described in the instant Figures and the instant specification.
The new claims 14-15 in this instant application claim the bold underlined instant elements of ”14. A communication apparatus that performs communication conforming to Institute of Electrical and Electronics Engineers (IEEE) 802.11 series standard using an Orthogonal Frequency Division Multiple Access (OFDMA) scheme, the communication apparatus comprising: at least one memory that stores a set of instructions; and at least one processing circuit, wherein the communication apparatus is caused, by the at least one processing circuit executing the set of instructions, to perform and/or the at least one processing circuit itself performs operations comprising: receiving, from an Access Point, a trigger frame that includes information about an association relationship of a plurality of resource units obtained by dividing a channel with a predetermined frequency bandwidth and Association Identifiers (AIDs) that are identification information of a plurality of communication apparatuses; measuring a radio intensity in the channel including a resource unit specified for the communication apparatus in the trigger frame; and performing transmission control to transmit data to the Access Point using two or more resource units in a case where the measured radio intensity is less than a predetermined threshold”; “15. The communication apparatus according to claim 14, wherein the two or more resource units include the specified resource unit”; the instant published [79] describes the elements of “For example, the Base Station 110 obtains information on the hardware of each communication and determines the transmission power of each communication device on the basis of the obtained information. Consideration is given to a case where, for example, two RUs out of four RUs are utilized and transmission permission is granted to a device for which the transmission power density can be quadrupled and a device for which the transmission power density is not increasable. In this case, the Base Station 110 determines that the transmission power is multiplied by three for the device for which the transmission power density can be quadrupled and determines that the transmission power density is multiplied by one for the device for which the transmission power density is not increasable. Thus, a radio field intensity exceeding a predetermined threshold that is used by the communication device 103 during carrier sensing can be achieved for the entire frequency channel while the hardware constraints of each device are satisfied”.
It indicates clearly that said bold underlined instant elements in instant independent claim 14 are NOT equivalent to the instant bold underlined elements in instant [79].
Therefore, the new claims 14-15 are not originally described in the instant [79].
The new claims 1-7, 8-12 in this instant application claim the bold underlined instant elements of ”1. A communication apparatus that performs communication conforming to Institute of Electrical and Electronics Engineers (IEEE) 802.11 series standard using an Orthogonal Frequency Division Multiple Access (OFDMA) scheme, the communication apparatus comprising: at least one memory that stores a set of instructions; and at least one processing circuit, wherein the communication apparatus is caused, by the at least one processing circuit executing the set of instructions, to perform and/or the at least one processing circuit itself performs operations comprising: receiving, from an access point, a trigger frame that includes information in which a plurality of resource units obtained by dividing a channel with a predetermined frequency bandwidth is associated with Association Identifiers (AIDS) that are identification information of a plurality of communication apparatuses and information that the communication apparatus uses to determine transmission power of the communication apparatus; and performing transmission control to transmit data to the access point using a resource unit associated with an AID of the communication apparatus in the trigger frame, wherein, in the transmission control, in a case where a plurality of resource units is associated with the AID of the communication apparatus in the trigger frame, control is performed to transmit the data using the plurality of resource units, and in a case where one resource unit is associated with the AID of the communication apparatus in the trigger frame, control is performed to transmit the data using the one resource unit, and wherein, in the transmission control, at transmitting the data, in a case where the information that the communication apparatus uses to determine the transmission power of the communication apparatus has a first value, control is performed to determine to use first transmission power and transmit the data using the first transmission power, in a case where the information that the communication apparatus uses to determine the transmission power of the communication apparatus has a second value greater than the first value, control is performed to determine to use second transmission power having greater power than first transmission power and transmit the data using the second transmission power, and in a case where the information that the communication apparatus uses to determine the transmission power of the communication apparatus has a third value greater than the first value and the second value, control is performed to determine to use third transmission power having greater power than the first transmission power and the second transmission power and transmit the data using the third transmission power”.
The instant independent claim 8 claims the transmitting apparatus, (e.g., the Access Point) having the technical transmission and reception features with the technical reception and transmission features of the instant independent communication apparatus claim 1, exchangeably.
Nowhere in instant Figures nor paragraphs in instant specification can describe new bold underlined elements in independent claims 1, 8 equivalently. Therefore, the new instant independent claims 1,2,4,5,7; 8-10,12 are not originally described in the instant Figures and the instant specification.
