Office Action

§102
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim(s) 1 and 4 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by US 2,909,035 to Mitton. Re-claim 1, Mitton discloses a non-powered flow intensifier, comprising: an intensifier housing 17; an intensifier cavity 25 is at least partially defined by the intensifier housing, the intensifier cavity has longitudinally spaced first cavity end (such as adjacent 54 and shoulder 19) and second cavity end (adjacent wall 42) with a central cavity axis extending longitudinally therebetween; an intensifier piston 37 longitudinally reciprocates within the intensifier cavity, at least partially responsive to fluid pressure within the intensifier cavity, the intensifier piston including a piston head portion 46 is longitudinally adjacent the first cavity end, a piston skirt portion 40 (a skirt is interpreted as an annular extension) extending from the piston head portion toward the second cavity end 42, a piston lateral bore 48 extends in a lateral direction at least partially through a solid body of the piston head portion and in fluid communication with the intensifier cavity via at least one lateral bore outlet of the piston head portion, a piston reducer bore 51 places the piston lateral bore 48 and an internal void 38 of the piston skirt portion in fluid communication; a fluid input port 26 is interposed longitudinally between the first and second cavity ends and placing the intensifier cavity in fluid communication with a source of pressurized hydraulic fluid 10; a fluid output port 28 is located at the second cavity end and places the intensifier cavity 25 in fluid communication with a wheel brake (see figure 1); the pressurized hydraulic fluid travels along an intensifier input fluid path at least from the fluid input port, through at least a portion of the intensifier cavity, the piston lateral bore, the piston reducer bore, and the internal void of the piston skirt, and exits the intensifier cavity via the fluid output port (see column 5 lines 18-26). Re-claim 4, a vent 76 communicates the first cavity end 54 with a surrounding atmosphere. Allowable Subject Matter Claims 12-20 are allowed. The following is a statement of reasons for the indication of allowable subject matter: The prior art fails to show or render obvious a brake system having a secondary brake module connected to the wheel brakes and having first and second intensifier assemblies. The brake system of Mitton relies upon pressure from a master cylinder and the connection of a single intensifier to the wheel brakes. Claims 2, 3 and 5-11 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Krusemark, Valentine and Saurwein each teach a fluid pressure intensifier.
