Claim Rejections - 35 USC § 112
3. The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
4. Claims 1-20 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 1 recites, “a first quantity of second pilot subcarriers is greater than a second quantity of third pilot subcarriers in the first low frequency channel”. It is not clear where the second pilot subcarriers are located. Are the second pilot subcarriers located in the low frequency channel, high frequency channel, or some other channel?
Claim 1 again recites, “a third quantity of second data subcarriers is equal to a fourth quantity of third data subcarriers in the first low frequency channel”. It is not clear where the second data subcarriers are located. Are the second data subcarriers located in the low frequency channel, high frequency channel, or some other channel?
Claims 2-15 depend upon claim 1 and thereby, are rejected for the reasons discussed above with respect to claim 1.
Claim 16 recites limitation similar to claim 1 above and thereby, is rejected for the reasons discussed above with respect to claim 1.
Claim 17 recites limitation similar to claim 1 above and thereby, is rejected for the reasons discussed above with respect to claim 1.
Claims 18-20 depend upon claim 17 and thereby, are rejected for the reasons discussed above with respect to claim 17.
Claims 2 and 18 recite, “performing, based on the pilot signal, processing”. It is not clear what is being processed based on the pilot signal?
Claims 6-12 recite index values of fourth pilot subcarriers and fifth pilot subcarriers. Claim does not define where fourth pilot subcarriers and fifth pilot subcarriers. Are the fourth pilot subcarriers and fifth pilot subcarriers located in the low frequency channel, high frequency channel, or some other channel? It is also not clear where the second guard subcarriers are located.
Relevant Prior Art
Park et al (US 20190123877 A1) discloses to generate a physical protocol data unit (PPDU) including a preamble and a data field. When the PPDU is transmitted using a 106 subcarrier/tone resource unit, four subcarriers are used for pilot signal. The positions of the four pilot subcarriers are identical to the pilot subcarriers included in four 26 subcarrier/tone resource unit. In case of 20 MHz transmission bandwidth, the indices of four pilot subcarriers are – {-21, -7, 7, 21} and for 40 MHz transmission bandwidth, the indices of six pilot subcarriers are {-53, -25, -11, 11, 25, 53}. Park discloses the pilot subcarrier indices corresponding to different transmission bandwidths (Fig. 18-19, Par 0328-0338, Par 0345-0347, Par 0402-0404, Par 0588-0589, Par 0665-0666).
Park et al (US 20230179330 A1) discloses to receive a PPDU including a legacy preamble and a first and second signal fields. The preamble and the first and second signal field are generated based on a phase rotation value applied to each 20 MHz bandwidth (Fig. 10, Par 0175-0186, Par 0189-0196).
Examiner’s comment
It has been discussed above that the claim limitations are not clear. As a result, examiner cannot make a rejection/allowance of the claims with respect to the available prior arts.
