Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-10 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 1 recites, “…when the coil layer is electrically conducted, the magnetic element senses the coil layer and vibrates, ...”
The first part of the sentence seems to be burbled/directly translated from a foreign language.
The second part of the above sentence requires magnetic element that “senses” the coil layer. Magnetic elements does not “sense” coils. Nothing in the disclosure suggest that the magnetic element is equipped with structure, such as a current sensor, that allows for the magnetic element to “sense” the coil element.
For examination purposes, the limitations in question are interpreted as, “…when the coil layer conducts electricity, the magnetic element responds the coil layer and vibrates, ...
Claims 2-10 are rejected for depending on claim 1.
Regarding claim 2: Claim 2 recites the limitation "the fixed portion". There is insufficient antecedent basis for this limitation in the claim.
Further claim 2 defines “a fixing portion”. It is not clear. If the fixing portion , and the fixed portion are the same or different elements.
Claims 3-4 are rejected for depending on claim 2.
Allowable Subject Matter
Claim 1 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action.
Closest prior art is Chung et al. (US 2011/0193426). Chung discloses the limitations of claim 1, but does not disclose “a coil layer is disposed within the accommodation space of the housing and aligned with the magnetic element;…”
Modifying Chung would require breaking the principle of operation of Chung. That being said. Not of the prior arts, alone or in combination disclose the combination of limitations of claim 1.
