Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . DETAILED ACTION Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. Claim 1 is rejected under 35 U.S.C. 102(a)(2) as being anticipated by Sato et al. (US 2015/0077523). Sato et al. et al. teach capturing a calibration target by the camera, and obtaining a first left image and a first right image by utilizing the lenses of the target peripheral; (Fig. 6A and 6B; Fig. 12, S101 and S102) performing a calibration operation on the mobile device according to the first left-view image and the first right-view image (Fig. 12, S103 and S104); obtaining a second left-view image and a second right-view image by employing the camera to capture a target scene (Fig. 2A ; and para [0034] The imaging unit 2 includes an image sensor having an array of solid-state imaging devices arranged in two dimensions, and imaging optics for focusing images captured of a subject through the stereo adapter 8 onto the upper half and lower half, respectively, of the image sensor. The imaging unit 2 forms the image of the subject on the upper half and lower half image regions); splicing the second left-view image and the second right-view image to obtain a 3D image (para [0038], The stereo image generating apparatus 6 generates the left-eye image by trimming, from the image captured by shooting the subject using the stereo adapter 8, the region containing the subject's image corresponding to the upper half of the captured image, and the right-eye image by trimming, from the captured image, the region containing the subject's image corresponding to the lower half of the captured image. Allowable Subject Matter Claims 2-7 are objected to as being dependent upon a rejected base claim, but would be allowable of rewritten in independent form including all of the limitations of the base claim and any intervening claims. Claims 8-19 are allowed. The following is an examiner’s statement of reasons for allowance: Claims 8 and 14 are allowable over the prior art of record because none of the prior art of record teaches the combined claimed elements as set forth in the claims 8 and 14. None of the prior art of record teaches or fairly suggests that image processing method for performing a calibration operation on the mobile device according to the first left-view image and the first right-view image which are taken in condition that the whole of the calibration target is presented in the left image and the right image, and the ratio of the size of the image of the calibration target to the size of the left image and the ratio of the size of the image of the calibration target to the size of the right image are both are greater than the preset value , and together with combination of other claimed elements as set forth in the independent claims 8 and 14. Therefore, the claims 8 and 14 are over the prior art of records. Claims 9-13 and 15-19 are allowed because they are depended on independent claims 8 and 14.
