Claim Rejections - 35 USC § 112
The following is a quotation of the second paragraph of 35 U.S.C. 112:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 8-12 are rejected under 35 U.S.C. 112, second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which applicant regards as the invention.
In claim 8, line 10, the language, “the first shield plate” lacks an antecedent basis.
In claim 9, lines 1-6, the language of the claims appear to conflict with claim 11, lines 1-6.
In claim 11, line 15, “a second acute angle” was claimed, however, it appears there is no “a first acute angle” was claimed in claim 6.
In claim 12, line 5, “a second acute angle” was claimed, however, it appears there is no “a first acute angle” was claimed in claim 8.
In claim 12, line 13, the language, “the first and second shield plates” lacks an antecedent basis.
Allowable Subject Matter
Claims 1-7 are allowed.
Claims 8-12 are rejected under 35 U.S.C. 112, second paragraph, but would be allowable if overcome the above rejection.
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. The patents to Hamminga, Proctor, Alexanian, Adams, Xue, Sato and Ozaki are cited as of interested and illustrated a similar structure to a radar system.
