DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . This action is in response to the application filed on 21 November 2024. Claims 1-18 are under examination. Information Disclosure Statement The information disclosure statement (IDS) submitted on 21 November 2024. The submission is in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement is being considered by the examiner. Double Patenting A rejection based on double patenting of the “same invention” type finds its support in the language of 35 U.S.C. 101 which states that “whoever invents or discovers any new and useful process... may obtain a patent therefor...” (Emphasis added). Thus, the term “same invention,” in this context, means an invention drawn to identical subject matter. See Miller v. Eagle Mfg. Co., 151 U.S. 186 (1894); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970); In re Ockert, 245 F.2d 467, 114 USPQ 330 (CCPA 1957). The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. Cir. 1985); In re Van Ornum, 686 F.2d 937, 214 USPQ 761 (CCPA 1982); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970); In re Thorington, 418 F.2d 528, 163 USPQ 644 (CCPA 1969). A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on nonstatutory double patenting provided the reference application or patent either is shown to be commonly owned with the examined application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. In regarding claims 1, 8, and 13 of the instant application, in view of the above, patent claim 1 does not disclose control receiving downlink control information including Demodulation Reference Signal (DMRS) antenna port information indicating the one or more antenna ports. Frenne discloses an control receiving downlink control information including Demodulation Reference Signal (DMRS) antenna port information indicating the one or more antenna ports (Paragraph 91). Therefore, it would have been obvious to one having ordinary skill in the art at the time the invention was made to modify claim 1 of U.S. patent number 12,191,946 to include disclose control receiving downlink control information including Demodulation Reference Signal (DMRS) antenna port information indicating the one or more antenna ports of Frenne. The motivation for combining U.S. patent number 12,191,946 and Frenne is to be able to improve the channel estimation performance and the data rate of the transmission may be increased. Dependent claims 2, 3, and 14 are rejected for the same reasoning as independent claims 1, 8, and 13. Dependent claims 4-7, 9-12, and 15-18 are duplicated of patent claims 2-5. Claims 1-18 are rejected on the ground of nonstatutory double patenting as being unpatentable over claims 1-10 of U.S. Patent No. 11,811,430 in view of Frenne et al. (US Publication 2014/0050159). In regarding claims 1, 8 and 13 of the instant application, in view of the above, patent claim 1 does not control receiving downlink control information including Demodulation Reference Signal (DMRS) antenna port information indicating the one or more antenna ports. Frenne discloses control receiving downlink control information including Demodulation Reference Signal (DMRS) antenna port information indicating the one or more antenna ports (Paragraph 91). Therefore, it would have been obvious to one having ordinary skill in the art at the time the invention was made to modify claim 1 of U.S. patent number 11,811,430 to include receiving downlink control information including Demodulation Reference Signal (DMRS) antenna port information indicating the one or more antenna ports of Frenne. The motivation for combining U.S. patent number 11,811,430 and Frenne is to be able to improve the channel estimation performance and the data rate of the transmission may be increased. Dependent claims 2, 3, and 14 are rejected for the same reasoning as independent claims 1, 8, and 13. Dependent claims 4-7, 9-12, and 15-18 are duplicated of patent claims 2-5. Claims 1-18 are rejected on the ground of nonstatutory double patenting as being unpatentable over claims 1-4 of U.S. Patent No. 11,632,153 in view of Frenne et al. (US Publication 2014/0050159). In regarding claims 1, 8 and 13 of the instant application, In view of the above, patent claim 1 does not disclose receiving downlink control information including Demodulation Reference Signal (DMRS) antenna port information indicating the one or more antenna ports. Frenne discloses receiving downlink control information including Demodulation Reference Signal (DMRS) antenna port information indicating the one or more antenna ports (Paragraph 91). Therefore, it would have been obvious to one having ordinary skill in the art at the time the invention was made to modify claim 1 of U.S. patent number 11,632,153 to include receiving downlink control information including Demodulation Reference Signal (DMRS) antenna port information indicating the one or more antenna ports of Frenne. The motivation for combining U.S. patent number 11,632,153 and Frenne is to be able to improve the channel estimation performance and the data rate of the transmission may be increased. Dependent claims 2, 3, and 14 are rejected for the same reasoning as independent claims 1, 8, and 13. Dependent claims 4-7, 9-12, and 15-18 are duplicated of patent claims 2-5. Claim 1 is rejected on the ground of nonstatutory double patenting as being unpatentable over claim 1 of U.S. Patent No. 11,005,543 in view of Frenne et al. (US Publication 2014/0050159). Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure, Seo et al. (US Publication 2013/0343340), discloses configures the reference signal for demodulation of the data being transmitted to the reception device by the transmission device, and transmits the reference signal to the reception device with the data. According to embodiments of the present invention, the demodulation performance for the data transmitted from the transmission device to the reception device is enhanced. The analogous prior art reference, Qu et al. (US Publication 2013/0083769), discloses the two reference signals span common resource elements (REs) in the RB or RB pair. Alternatively, a zero-power problem can be avoided by assigning modified WALSH codes to the two reference signals, and transmitting the two reference signals in the RB or RB pair carrying the control channel in accordance with their modified WALSH codes. The modified WALSH codes include complex constants having a non-zero phase difference with one another. A control channel can be evenly partitioned in accordance with a checkerboard partitioning technique.
