Office Action

§102 §112
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Priority Acknowledgment is made of applicant's claim for foreign priority based on an application filed in France on 11/28/2023. It is noted, however, that applicant has not filed a certified copy of the FR2313163 application as required by 37 CFR 1.55. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-12, rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claim 1, recites the limitation "the dome" in line 12. There is insufficient antecedent basis for this limitation in the claim. Claim 1, recites the limitation "the section" in in line 20. There is insufficient antecedent basis for this limitation in the claim. Claim 8, defines “the ring delimits an open volume the section of which, in a plane orthogonal to the central axis, has a monotonic variation. These highlighted element where already introduced in claim 1. This is a double inclusion error. These elements should be referred to as -said- or -the- . Claim 10, recites the limitation "the holding structure" in line 1. There is insufficient antecedent basis for this limitation in the claim. Claim 11, states “thus obtained into the outer shell”. The phrasing does not make sense. Probably a typo. Claim Rejections - 35 USC § 102 No art rejection applied.
