The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Election/Restrictions
Applicant's election without traverse of invention I (claims 1-3 and 5-9) and claims 11-13 and 4 and 10 canceled in the reply filed on 07/02/2026 is acknowledged.
The requirement is still deemed proper and is therefore made FINAL.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 3,5-7 and 9 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 3 recites the limitation "an isolation protection board" in line 2. There is insufficient antecedent basis for this limitation in the claim because applicant has already claimed “an isolation protection board” in claim 1 line 4 so it is unclear if it is the same board or a new one. For purpose of examination, the limitation will be interpreted as “the isolation protection board”. Claims 5-7 and 9, which depend from claim 3, are similarly rejected.
Claim 5 recites the limitation "a bracket" in line 5. There is insufficient antecedent basis for this limitation in the claim because applicant has already claimed “a backet” in claim 1 line 2 so it is unclear if it is the same board or a new one. For purpose of examination, the limitation will be interpreted as “the bracket”. Claims 6-7 and 9, which depend from claim 3, are similarly rejected.
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1-3 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Boersma (US10322845B2).
Regarding claim 1, Boersma an inner packaging structure for a network distribution frame, used to package a distribution frame body and a bracket (fig.4 shows the inner packaging structure 12 for a network distribution frame to package a frame body with a bracket 131; it is noted that inner packaging structure can be used to store a frame body and bracket as that is intended use and applicant has not positively claimed those two yet ), characterized by comprising an isolated protection board, wherein the isolated protection board is able to divide an internal space of a packaging box into at least two product placing chambers (fig.4 shows the isolation board 113 that is capable of dividing the internal space created by the package 150 by the sidewalls 25 and 17), and the isolated protection board is able to mutually abut against at least part of areas of at least one of the distribution frame body and the bracket (fig.4 shows the board 113 abuts against the bracket 131).
Regarding claim 2, the references as applied to claim 1 above discloses all the limitations substantially claimed. Boersma further teaches a cover body and a box body with an open top, wherein the inner packaging structure is located in the box body (fig.4 shows the cover body 45 and 35 and box body 17,25,21 and the inner packaging 12 is located inside it).
Regarding claim 3, as best understood based on 112 issue identified above, the references as applied to claim 2 above discloses all the limitations substantially claimed. Boersma further teaches protection board comprises a first crease and a second crease, the isolated protection board is able to swing back and forth along the first crease connected with the box body, and the isolated protection board is divided into a first bendable bending board and a second bendable bending board through the second crease (fig.4 shows the board 113 with a first crease at 145 and second crease at 115 that are able to swing back and forth with the box body and the board is divided into first and second bendable thought the creases).
Allowable Subject Matter
Claims 5-7 and 9 objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
