Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claim 7 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
“ preferably” confuses the scope of the claim and is thus indefinite.
PRODUCT BY PROCESS CLAIM:
“ The subject matter present is regarded as a product by process claim in which a product is introduced by the method in which it is made. It is the general practice of this office to examine the final product described regardless of the method provided by the applicant.”
Claim 6 “ punched…” is product by process limitation and is treated according to the office policy above.
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
Claim(s) 1-20 are is/are rejected under 35 U.S.C. 102a1 as being anticipated by Taylor (WO99/42694).
Taylor figures 2-6, shows a building security screen assembly including:
a frame(41); at least one insert(44, figure 2) for inserting in the frame; and a security screen(14) for fastening to the insert.
Per claim 2, Taylor further shows the security screen(metal/plastic and frame(aluminum) include dissimilar metals, and each insert is electrically non-conductive thereby impeding electrolysis(plastic).
Per claim 3, Taylor further shows the frame and screen do not come into direct contact.
Per claim 4, Taylor shows each insert forms an insulative barrier (plastic).
Per claim 5, Taylor further shows no electrical path between the frame and screen.
Per claim 6, Taylor further shows the frame includes metal, the screen includes a punched(product by process limitation) metal sheet, and each insert is an electrical insulator.
Per claim 7, Taylor further shows the screen is received in the insert, and preferably slid into the insert during assembly.
Per claim 8, Taylor further shows the screen is compression fastened within the insert or is fastened to each insert using one or more fasteners.
Per claim 9, Taylor further shows the frame includes frame elements(32), each frame member receiving a respective insert axially slid into a respective frame member.
Per claim 10, Taylor further shows each frame member includes a structural or connection portion(33), and an insert receiver for receiving each insert adjacent to the structural or connection portion.
Per claim 11, Taylor further the structural or connection portion is tubular.
Per claim 12, Taylor further shows each insert receiver includes one or more retainers for retaining each insert within the frame member.
Per claim 13, Taylor(figure 2) further shows each retainer includes a pair of protrusions to impede lateral withdrawal of each insert from the frame member.
Per claim 14, Taylor further shows each insert receiver includes two retainers wherein one of the retainers(the top protrusion in figure 2) is exposed whereas the other retainer(the other retainer forming the serrated teeth) is concealed within the insert receiver.
Per claim 15, Taylor further shows each insert forms a snug fit with the retainers, each insert defining a dock for the screen to be docked in, each insert defining a stop to stop the screen and/or each insert is pi-shaped.
Per claim 16, Taylor further shows each insert includes a body from which a pair of legs extend, the body protruding beyond the legs, each insert including a pair of retaining feet protruding from respective legs, the feet protruding outwardly and/or the legs tapering inwardly to facilitate insertion of the screen(figure 2).
Per claim 17, Taylor further shows a building security screen assembly including:
a frame member; an insert for inserting in the frame member; and a security screen for fastening to the insert.
Per claims 18-19, Taylor further shows a method for forming a building security screen assembly, the method including: fastening a security screen to at least one insert; and inserting the insert in a frame, wherein the step of inserting involves sliding the insert into position within the frame.
Per claim 20, Taylor further shows a method for forming a building security screen assembly as claimed in claim 18, wherein the step of fastening involves sliding the security screen into the insert and screwing the security screen to the insert(screen is optionally fastened to the insert by screws/fasteners).
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. The prior art shows different screen frame assemblies.
