Claim Rejections - 35 USC § 102 07-06 AIA 15-10-15 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. 07-07-aia AIA 07-07 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – 07-08-aia AIA (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. 07-15-aia AIA Claim(s) 1-2, 5-6, 10 is/are rejected under 35 U.S.C. 102 (a)(1) as being anticipated by Takagi et al (U.S. Pub. 2004/0105996) Regarding claim 1, a multilayer belt, comprising: a metal layer (1) (Figure 1; Paragraph 0052) formed in an endless shape A resin layer (3) (Figure 1; Paragraphs 0052, 0064) provided at the metal layer A low reflective layer (2; silicone rubber or the like; fluorine rubber; Paragraph 0075, 0078) (Paragraphs 0052-0053; Figure 1) provided at least partially between the metal layer (1) and the resin layer (3), and having a light reflectance lower than that of the metal layer (stainless steel is known to be highly reflective vs fluorine rubber (FKM) which has a low reflectance) Regarding claim 2, the low reflective layer is provided at least partially in a direction intersecting a circumferential direction of the meal layer (Figure 1) regarding claim 5, wherein the resin layer is formed of a fluorine-based resin (Paragraphs 0052-0053, 0075, 0078) regarding claim 6, a medium transport device comprising a belt transport unit provided with the multiplayer belt and configured to transport a medium (Paragraphs 0003-0006) regarding claim 10, a recording device, comprising: a belt transport unit provided with the multilayer belt and configured to transport a medium; and a recording unit configured to perform recording on the medium transported by the belt transport unit (Paragraphs 0003-0006, 0042) Claim Rejections - 35 USC § 103 07-06 AIA 15-10-15 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 07-20-aia AIA The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. 07-21-aia AIA Claim (s) 3 is/are rejected under 35 U.S.C. 103 as being unpatentable over Takagi et al (U.S. Pub. 2004/0105996) in view of Shinkawa (U.S. Pub. 2009/0184987) Regarding claim 3, Shinkawa discloses it is known in the art to use a transport belt to incorporate a black color (Paragraph 0032) It would have been obvious to a person of ordinary skill in the art before the effective filing date of the claimed invention to incorporate the teaching of Shinkawa into the device of Takagi, for the purpose of forming a difference of reflected light between the substrate and belt 07-21-aia AIA Claim (s) 4 is/are rejected under 35 U.S.C. 103 as being unpatentable over Takagi et al (U.S. Pub. 2004/0105996) in view of Greive et al (U.S. Pat. 6,176,484) Regarding claim 4, Greive discloses forming a transport belt with austenitic stainless steel (Column 3, Lines 30-43) It would have been obvious to a person of ordinary skill in the art before the effective filing date of the claimed invention to incorporate the teaching of Greive into the device of Takagi, for the purpose of providing a stable form of transportation of the medium on the conveyance apparatus Allowable Subject Matter 12-151-08 AIA 07-43 12-51-08 Claim s 7-9, 11-13 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
