Claim Rejections - 35 USC § 101
35 U.S.C. 101 reads as follows:
Whoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefore, subject to the conditions and requirements of this title.
Claim 8 rejected under 35 U.S.C. 101 because the claimed invention is directed to non-statutory subject matter. The claim(s) does/do not fall within at least one of the four categories of patent eligible subject matter because it is directed to a program for causing a computer to… This is a computer program per se (often referred to as "software per se"). See MPEP 2106.03.
Allowable Subject Matter
Claims 1-7 allowed.
The following is an examiner’s statement of reasons for allowance: closest prior arts are, ITO et al. (US 20210027109) discussed optimization and prediction model using a machine learning engine such as factorized asymptotic Bayesian inference. Berkenkamp et al (US 20220097227) discussed control parameters values, Bayesian 20220097227. No prior arts teach all claim limitations.
