Claim 4 is objected to because of the following informalities: Claim 4, line 4 has extra dash between “15-20”. Appropriate correction is required.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-6 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
In Claims 1 and 6, the phrase performing a “granulation, a polishing, and a first drying in turn” is not understood. What is being granulated, polished, and first dried? What is “in turn”?
In Claim 1, what is “performing a second drying…in turn”?
In Claim 1, the term “mass” is indefinite because the mass of a chemical does not change. It is inherent with the chemical. Do you mean weight?
In Claim 3, the “500 g: (400-450) mL: (40-50) mL” is indefinite because one does not know what is the ratio and why is the parentheses present. Is it part of the claim? For a ratio to make sense, the ratio should be in the same measurement unit. Please amend.
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 6 is rejected under 35 U.S.C. 102(a)(1) as being anticipated by Liu et al. (from IDS, CN 113061194 A).
Liu et al. teaches a method of preparing lycopyllum decastes sporocarp polysaccharide comprising dry powder of sporocarp extracted with absolute ethyl alcohol, removed absolute ethyl alcohol and extract with water, dried the alcohol precipitate, and redissolved precipitate with distilled water, and freeze dried to obtain lycophyllum decastes sporocarp polysaccharide (Abstract).
Conclusion
No claim is allowed.
