Office Action

§102 §103 §112
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Priority Receipt is acknowledged of certified copies of papers required by 37 CFR 1.55. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 16 and 18 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claim 16 recites the limitation "the driving-motor water pump" in line 2. There is insufficient antecedent basis for this limitation in the claim. While the pump in question is recited in claim 15, Claim 16 depends from claim 10 not claim 15. Claim16 recites the limitations “the battery loop” and "the battery water pump" in line 2. There is insufficient antecedent basis for this limitation in the claim. While the loop and pump in question are recited in claim 17, Claim 18 depends from claim 10 not claim 17. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim(s) 1-2, 5-12 and 15-18 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Cheng et al. (CN 114801659 A). Claim Rejections - 35 USC § 103 In the event the determination of the status of the application as subject to AIA 35 U.S.C. The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. Claim(s) 3-4 and 12-13 is/are rejected under 35 U.S.C. 103 as being unpatentable over Cheng et al. (CN 114801659 A) in view of Heyl (US 2021/0252940 A1). Regarding claim 3, Cheng discloses the claim limitations of claim 1 above however Cheng does not disclose the air conditioning water pump further comprises a first three-way valve, and the first three-way valve is connected to the heating water pump. As Cheng is silent as to a three way valve. Heyl teaches a vehicle thermal management system with a three way valve for directing fluid ( at three way valve 22). It would have been obvious to one having ordinary skill in the art at the time the invention was effectively filed to have modified the water circulation system of Cheng to have included a three way valve doing so would allow for flow switching/ redirecting flow between elements within the circuit. Doing so would allow for redirection fluid flow as required as a known means for implementing circuits as recognized by Heyl (per paragraph 0036). Regarding claim 4, Cheng discloses the claim limitations of claim 1 above however Cheng does not disclose wherein the air conditioning water pump further comprises a second three-way valve, and the cooling water pump is connected to the second core via the second three-way valve. Heyl teaches (figure 1-3) a vehicle thermal management system with a three way valve for directing fluid ( at three way valve 22). Regarding claim 12, Cheng discloses the claim limitations of claim 10 above however Cheng does not disclose the air conditioning water pump further comprises a first three-way valve, and the first three-way valve is connected to the heating water pump. Regarding claim 13, Cheng discloses the claim limitations of claim 10 above however Cheng does not disclose wherein the air conditioning water pump further comprises a second three-way valve, and the cooling water pump is connected to the second core via the second three-way valve. Heyl teaches (figure 1-3) a vehicle thermal management system with a three way valve for directing fluid ( at three way valve 22). Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Hu et al. (US 20230226877 A1) and Enomoto et al. (US 20160339761 A1) disclose relevant vehicle air conditioning systems where Hu can read on at least claim 1.
