DETAILED ACTION
Election/Restrictions
Newly submitted claims 7-20 are directed to an invention that is independent or distinct from the invention originally claimed for the following reasons. The original invention was directed to an article having a first side and second side defining an opening therebetween. The article included a plurality of guide members and a plurality of attachment points. Wherein, the number of guide members is fewer than the number of attachment points. Each guide member is configured for releasable coupling with any one of the attachment points.
Claims 7-14 are directed to a subcombination of original and amended claim 1, i.e., to a single guide body with a channel. The combination does require the particulars of the subcombination defined in claims 7-14, i.e., a channel that extends through the guide body from the first side to the second side; the channel configured so that the tension member is insertable within the channel. Therefore, the combination is distinct from the subcombination.
The now claimed invention of claims 15-20 is directed to an article and a method of providing a single guide member having a guide body with a first side and a second side and a channel extending therethrough so that a tension member is insertable within the channel. The single guide member has a first and a second through-hole. The claimed method then states that a first fastener is inserted through the first through-hole to fasten the guide member to a first attachment point and a second fastener is inserted through the second through-hole to fasten the single guide member to a second attachment point.
The article and method of claims 15-20 are distinct from original claim 1 and the amended claim 1 in that it can be used to make a materially different product that has a single guide member, e.g., in a bag for closing the opening in the bag with a single guide member and tension member.
Since applicant has received an action on the merits for the originally presented invention, this invention has been constructively elected by original presentation for prosecution on the merits. Accordingly, claims 7-20 are withdrawn from consideration as being directed to a non-elected invention. See 37 CFR 1.142(b) and MPEP § 821.03.
To preserve a right to petition, the reply to this action must distinctly and specifically point out supposed errors in the restriction requirement. Otherwise, the election shall be treated as a final election without traverse. Traversal must be timely. Failure to timely traverse the requirement will result in the loss of right to petition under 37 CFR 1.144. If claims are subsequently added, applicant must indicate which of the subsequently added claims are readable upon the elected invention.
Should applicant traverse on the ground that the inventions are not patentably distinct, applicant should submit evidence or identify such evidence now of record showing the inventions to be obvious variants or clearly admit on the record that this is the case. In either instance, if the examiner finds one of the inventions unpatentable over the prior art, the evidence or admission may be used in a rejection under 35 U.S.C. 103 or pre-AIA 35 U.S.C. 103(a) of the other invention.
Claim Objections
Claims 1 is objected to because of the following informalities: “thru” should be spelled with the formal spelling “through”. Appropriate correction is required.
Drawings
The drawings are objected to under 37 CFR 1.83(a). The drawings must show every feature of the invention specified in the claims. Therefore, the article having a combination of a plurality of removable guide members with at least one fixed guide member having a first and second through-holes for receiving rivets to secure a rotational position of the one guide member must be shown or the feature(s) canceled from the claim(s). No new matter should be entered.
Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance.
Claim Rejections - 35 USC § 112
The following is a quotation of the first paragraph of 35 U.S.C. 112(a):
(a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention.
The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112:
The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention.
Claims 1-6 are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the written description requirement. The claims contain subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of the claimed invention.
The original disclosure fails to describe the article having a combination of a plurality of removable guide members with at least one fixed guide member having a first and second through-holes for receiving rivets to secure a rotational position of the one guide member to the article as stated in claims 1-6.
Response to Amendment
The amendment filed 8/25/2026 is objected to under 35 U.S.C. 132(a) because it introduces new matter into the disclosure. 35 U.S.C. 132(a) states that no amendment shall introduce new matter into the disclosure of the invention. The added material which is not supported by the original disclosure is as follows: the article having a combination of a plurality of removable guide members with at least one fixed guide member having a first and second through-holes for receiving rivets to secure a rotational position of the one guide member.
Applicant is required to cancel the new matter in the reply to this Office Action.
Conclusion
Applicant's amendment necessitated the new ground(s) of rejection presented in this Office action. Accordingly, THIS ACTION IS MADE FINAL. See MPEP § 706.07(a). Applicant is reminded of the extension of time policy as set forth in 37 CFR 1.136(a).
A shortened statutory period for reply to this final action is set to expire THREE MONTHS from the mailing date of this action. In the event a first reply is filed within TWO MONTHS of the mailing date of this final action and the advisory action is not mailed until after the end of the THREE-MONTH shortened statutory period, then the shortened statutory period will expire on the date the advisory action is mailed, and any nonprovisional extension fee (37 CFR 1.17(a)) pursuant to 37 CFR 1.136(a) will be calculated from the mailing date of the advisory action. In no event, however, will the statutory period for reply expire later than SIX MONTHS from the mailing date of this final action.
