Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-20 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 1 recites, “printing a first base printing layer ……;
determining printing inkjet data of a first color layer based on the actual printing trajectory of the first base printing layer;
printing the first color layer on the first base printing layer based on the printing inkjet data of the first color layer to obtain an additive printed object”
It is not clear what all is meant by and encompassed by the phrase, “determining printing inkjet data of a first color layer”. Is it the color of an ink of the inkjet printer, the nozzle of the inkjet printer, the color of an object, the color of a layer of material to be printed? It is not clear what applicant is referring to as, “determining printing inkjet data of a first color layer…” as recited in the claims. As such it is not clear what all is meant and encompassed by the phrase, “printing the first color layer……”.
In addition, in claim 1 it is not clear whether applicant meant to write the phrase, “printing a first base printing layer” as -- printing a first base layer..? That is, the layer does not print itself, rather a printer prints a layer of an object that is to be printed. The claim limitations become verbose and confusing because the phrase is not expressed in proper idiomatic English.
Applicant is herein requested to make corrections to further prosecution.
The rest of the claims are rejected for depending on a rejected claim or for having similar deficiencies as the rejected base claim.
Conclusion
The prior art [Buller US 2023/0191490 A1, US 2019/0143412; McAlpine US 11820061 B2; KRITCHMAN US 20230158739 A1] made of record and not relied upon is considered pertinent to applicant's disclosure.
