Office Action

§102
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim(s) 16-20 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by BORSOTTO et al. (FR 2964717). Regarding claim 16, BORSOTTO discloses method for shifting gears of a transmission, comprising: via a controller (17), adjusting an order of clutch phases (Fig. 2a,b, t2-t3 is the equivalent of the torque transfer phase, and Fig. 2a,b, t3-t4 is the equivalent of the clutch speed synchronization phase during an upshift; Fig. 4a,b, t3-t5 is the equivalent of the torque transfer phase, and Fig. 2b, t2-t3 is the equivalent of the clutch speed synchronization phase during a down shift) for a transmission gear shift according to a sign of a clutch torque (upshift or downshift); and via the controller, commanding an electric machine (5) and a clutch (3, 9, 10) according to the order of clutch phases for the transmission gear shift. Regarding claim 17, BORSOTTO discloses the order of clutch phases includes a clutch filling phase (t0-t2), torque transfer phase, and a clutch speed synchronization phase. Regarding claim 18, BORSOTTO discloses the order of clutch phases includes where the clutch filling phase is before the torque transfer phase and the torque transfer phase is before the clutch speed synchronization phase (Figs. 2a,b; upshift). Regarding claim 19, BORSOTTO discloses the order of clutch phases includes where the clutch filling phase is before the clutch speed synchronization phase and the clutch speed synchronization phase is before the torque transfer phase (Figs. 4a,b; downshift). Regarding claim 20, BORSOTTO discloses the electric machine is commanded to a torque, the torque based on an off-going gear ratio, an on-coming gear ratio, and a transmission inertia. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. DE 102016114087 A1: Fig. 2 and Fig. 4 show a change in the phases.
