And claims 21-40 are newly presented via preliminary amendment. The present application is a continuation of International application no. PCT/KR2023/006308, filed on May 9th, 2023, which claims priority to the Republic of Korea application no. KR10-2022-0069955, filed on June 9th, 2022. The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Allowable Subject Matter Claims 24, 29, 34, and 39 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. Claims 21-23, 25-28, 30-33, 35-38, and 40 are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Zewail et al (U.S. Patent Application Publication no. 2022/0369316, hereinafter Zewail). With respect to claims 21, 26, 31, and 36, Zewail discloses a method and electronic device performed by a radio unit (RU), distributed unit (DU) (paragraph [0304], lines 1-4), the method comprising: receiving, from a distributed unit (DU) through a fronthaul interface (paragraph [0308], lines 15-20), a control plane (C-plane) message including frame structure information (paragraph [0310], lines 7-18, control plane functionality), wherein the frame structure information includes information indicating a size of fast fourier transform (FFT) or inverse FFT (iFFT) (paragraph [0312], lines 1-8; paragraph [0340], lines 15-18), and numerology information (paragraph [0341], lines 1-5); and identifying a subcarrier spacing (SCS) based on the numerology information (paragraph [0341], lines 1-5), and wherein: based on the numerology information being a designated value, the SCS is 480 kilohertz (kHz) (paragraph [0350], lines 1-7), and based on the numerology information being another designated value, the SCS is 960 kHz (paragraph [0350], lines 1-7). With respect to claims 22, 27, 32, and 37, Zewail discloses the method of claims 21, 26, 31, and 36, further comprising: receiving, from the DU through the fronthaul interface, a management plane (M-plane) message including information related to a frequency band (paragraph [0308], lines 1-12). wherein the information related to the frequency band is used to identify a type among types for an SCS set being available (paragraph [0341], lines 1-5), and wherein the types for the SCS set include a first type including 480 kHz and 960 kHz and a second type not including 480 kHz and 960 kHz (paragraph [0350], lines 1-7). With respect to claims 23, Zewail discloses a method of claims 22, 27, 32, and 37, wherein the identified SCS corresponds to a value of the numerology information based on a table in accordance with the identified type (paragraph [0341], lines 1-5). With respect to claims 25, 28, 33, and 38, Zewail discloses a method of claims 21, 26, 31, and 36, wherein a section type of the C-plane message is a section type 3 used for physical random access channel (PRACH) and mixed numerology channels (paragraph [0311], lines 1-11), and the frame structure information is included in section information of the C-plane message (paragraph [0310], lines 7-18; paragraph [0339]), or wherein a section type of the C-plane message is a section type 5 for user equipment (UE) scheduling information or section a type 6 for transmitting UE channel information (paragraph [0331]), and the frame structure information is included in section extension information of the C-plane message (paragraph [0310], lines 7-18; paragraph [0339]). Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Chande Pat. Pub. 2023/0113912 Tsai Pat. Pub. 2024/0179737 Cheng Pat.
