DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Priority
Receipt is acknowledged of certified copies of papers required by 37 CFR 1.55.
Information Disclosure Statement
The information disclosure statement (IDS) submitted on 12/8/2024 complies with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement is being considered by the examiner.
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by KANG et al. (JP 2007183270 A).
Regarding claim 1 Kang et al teaches the use (Intended use recitation) of sensors based on multilayer carbon nanotubes functionalized with -oh and -cooh groups, comprising for (Intended use recitation) detecting CO2 in gaseous environments.
Allowable Subject Matter
Claims 2-10 are allowed.
The following is an examiner’s statement of reasons for allowance:
Kang et al (JP 2007183270 A) discloses a gas sensor using carbon nanotubes that includes a first electrode and a second electrode formed on a substrate, and the first electrode and the second electrode formed on the substrate. A light source installed on the upper side of the carbon nanotube, and an ammeter for measuring a current between the first electrode and the second electrode. A vacuum chamber that can be attached to and detached from the bottom of the substrate, the light source is installed at the top of the vacuum chamber, and a gas inlet is formed on one side of the vacuum chamber. (Tech-Solution)
Hannon et al (US 20250067694 A1) discloses providing sensors comprising an electrically conductive structure; a composite in electrical communication with the electrically conductive structure, the composite comprising functionalized carbon nanotubes decorated with a plurality of metal nanoparticles; and a humidity sensor in proximity to the composite. Providing a sensor comprising an electrically conductive structure and a composite in electrical communication with the electrically conductive structure; wherein the composite comprises functionalized carbon nanotubes decorated with a plurality of metal nanoparticles; contacting a fluid comprising nitric oxide with the composite; determining an electrical response of the composite upon contacting the fluid therewith; and correlating the electrical response with a concentration of nitric oxide (Summary)
Regarding claim 2, the cited pertinent art of record does not anticipate nor render obvious exposing a sensor to an atmosphere with a gas flow containing CO₂, controlling valves of different gas compartments, and calculating the current Ico2 (t) that passes through the sensor; f) Turn off the gas flow containing CO₂ and calculate the gain G (t) according to equation eq1, where the minimum exposure time texp of the sensor to the gas flow containing CO₂, preferably between texp = 60 S and texp = 300 S, is chosen to favor the distinction of G (t) for each value of the concentration of CO₂; G (t) = (Ico₂ (t) Ibase (t))|/Ibase (t) eq1; g) Plot a gain graph G(t) as a function of time t; and h) obtain the area AG under the curve of the gain graph G(t) and the maximum gain value Gmax from the gain value (t) obtained in steps "f" and "g", i) Submit the features area AG and maximum gain value Gmax obtained in step "h", as input data for the trained model to obtain concentrations, where the label of each result assigned by the trained model for obtaining concentrations is the predicted concentration of CO₂.
Claims 3-10 are allowed based on their dependency on claim 2.
Any comments considered necessary by applicant must be submitted no later than the payment of the issue fee and, to avoid processing delays, should preferably accompany the issue fee. Such submissions should be clearly labeled “Comments on Statement of Reasons for Allowance.”
