Office Action

§112
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1 – 14 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claim 1 recites the limitation "the magnetic field" in line 2. There is insufficient antecedent basis for this limitation in the claim. Claim 1 recites the limitation "the result" in line 19. There is insufficient antecedent basis for this limitation in the claim. As to claim 1, it is unclear how subsequent threshold value is chosen in accordance with the first measurement signal? However, fails to disclose the steps how the subsequent threshold value is chosen in accordance with the first measurement signal. Claim 2 recites the limitation "the absolute value" in lines 3 and 4. There is insufficient antecedent basis for this limitation in the claim. Claim 3 recites the limitation "the direction of maximum sensitivity" in line 2. There is insufficient antecedent basis for this limitation in the claim. Claims 2 - 14 are rejected by virtue of their dependency on claim 1. Allowable Subject Matter Claims 1 - 14 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action. Prior Art of Record The prior art made of record and not relied upon is considered pertinent to applicant s disclosure. Stollberger et al. (2024/0240972) is cited for its disclosure of communication in multi-carrier systems, linear motors and transport devices, in particular the communication in components of multi-carrier systems, linear motors and transport devices that are movable relative to one another. Ionescu (8,669,759) is cited for its disclosure of magnetic field switches. Phillips (3,906,486) is cited for its disclosure of bipolar dual ramp analog to digital converters.
