DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Office Action Summary
This is the initial office action for application 18/975682 filed 12/10/2024.
Claims 1-15 are currently pending and have been fully considered.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-15 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
The term “brown” in claims 1, 6 and 11 are relative terms which renders the claim indefinite. The term “brown” is not defined by the claim, the specification does not provide a standard for ascertaining the requisite degree, and one of ordinary skill in the art would not be reasonably apprised of the scope of the invention. It is unclear what amounts of D2SO4 and (CD3)2SO are being added given that the term “brown” is relative.
The term “pale yellow” in claims 1, 6, 11 and 15 is a relative term which renders the claim indefinite. The term “pale yellow” is not defined by the claim, the specification does not provide a standard for ascertaining the requisite degree, and one of ordinary skill in the art would not be reasonably apprised of the scope of the invention. It is unclear what level of sonicating or time heated is required given that the term “pale yellow” is subjective.
The term “drop” in claims 3, 5, 8, and 13 is a relative term which renders the claim indefinite. The term “drop” is not defined by the claim, the specification does not provide a standard for ascertaining the requisite degree, and one of ordinary skill in the art would not be reasonably apprised of the scope of the invention. The term “drop” is subjective and it is unclear the amounts that are employed of D2SO4 or triehylamine.
It appears that triehylamine is triethylamine.
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
