Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
ART REJECTION:
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1-2 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Yanai(USPGPUB 2005/0128061).
-- In considering claims 1-2, the claimed subject matter that is met by Yanai includes:
1) the in-vehicle display is met by the display device(8);
2) a display control unit configured to control the display of the in-vehicle display is met by the controller(20)(see: Yanai, sec[0033]);
3) the display control unit is configured to perform a follow target highlight display for a preceding vehicle icon corresponding to a preceding vehicle traveling ahead of the host vehicle on the in-vehicle display when the host vehicle performs following control on the preceding vehicle is met by the controller(20), which shows ranges of areas to be monitored, and typical movements of obstacles in the areas, and highlighted on the display(see: Yanai, sec[0010]);
4) wherein, during the execution of the following control, the display control unit is configured not to display an icon corresponding to a pre-preceding vehicle traveling ahead of the preceding vehicle on the in-vehicle display is met by the display only displaying a preceding vehicle, such as seen in figure 3A(see: Yanai, sec[0011]);
5) wherein, during the execution of the following control, the display control unit is configure to perform a deceleration control target display for a pre-receding vehicle icon corresponding to the pre-preceding vehicle on the in-vehicle icon corresponding to the pre-preceding vehicle on the in-vehicle display while maintaining the following target highlight display for the preceding vehicle icon when the pre-preceding vehicle becomes a deceleration control target of the host vehicle is met by the control flow causing the vehicle to detect the running condition and positional relationship of the obstacle within the range of the field of view of the camera(see: Yanai, sec[0027]), and causing the vehicle to alert driver and annunciation of the running conditions(see: sec[0031]).
Allowable Subject Matter
Claims 3-5 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
