Office Action

§102
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim(s) 15 is/are rejected under 35 U.S.C. 102 (a)(1) as being anticipated by Ding (US 20190094696 A1). Regarding claim 15, Ding teaches (reproduced and annotated Figs. below) a structural device, for progressively moving a bottom chamber (30) either away from or toward a top chamber (70), wherein the structural device comprises: a plate (10); a first spacer device (22), mountable on the plate; a height adjustable device (54), mountable on or beneath the first spacer device, wherein the height adjustable device comprises at least one simple machine (telescopic structure) to adjust a height thereof; a pneumatic lifting device (40), mountable on the plate, wherein the pneumatic lifting device is inflatable and deflatable to adjust a height thereof; a second spacer (52), mountable on the pneumatic lifting device; wherein the bottom chamber is mountable on the plate, the height adjustable device, the first spacer device, the pneumatic lifting device, or the second spacer. PNG media_image1.png 1249 1059 media_image1.png Greyscale Allowable Subject Matter Claims 1-14 are allowed. Claims 16-20 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Claims 1 and 8 are allowed for disclosing steps of moving and lifting. The closest prior art to the claimed invention of claims 1 and 8 is Ding. Ding teaches (reproduced and annotated Figs. above) a bottom chamber (30), a top chamber (70), a plate (10); a first spacer device (22); a height adjustable device (54); a pneumatic lifting device (40); a second spacer (52). However Ding does not teach the claimed steps of moving and lifting.
