Office Action

§103 §112
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-2, 4, 6-8, 10-11, 13 is/are rejected under 112, second paragraph as being indefinite for failing to particularly point and distinctly claim the subject matter which applicant regards as the invention In claim 1, recites "in case of” is not clear whether this intended to perform anything. However, the claims will be given a broad reasonable interpretation for the purposes of examination as best understood. Claim Rejections - 35 USC § 103 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. Claim(s) 1-2, 4, 6-8, 10-11, 13 is/are rejected under 35 U.S.C. 103 as being unpatentable over Min WO 2022044908 in view of Hwang WO 2021066567 1. A method for processing a successful handover report, comprising: obtaining, by a terminal, configuration information of a first trigger condition for generating a successful handover report of a primary secondary cell (MIN: [0091] the UE 200 determines whether or not the trigger condition for the Successful handover Report transmission is satisfied); in case of addition of a secondary node SN accessed by the terminal or change of the primary secondary cell, generating a first successful handover report, according to the configuration information, when determining that the first trigger condition is met (MIN: [0093-0104] he UE200 may send a Successful handover Report if any of the trigger conditions shown below is satisfied…….., in the case of MN / SN initiated PSCell change, the following contents may be included in the Successful handover Report in addition to the contents of the Successful handover Report shown in FIGS. 5A, 5B and 5C.); and sending the first successful handover report to a first master node MN accessed by the terminal (MIN: [0103] In the case of SN initiated PSCell change, UE200 may send a Successful handover Report to the master node (MN) using ULInformationTransfer MRDC message). Min merely discloses the memories Hwang further teaches the term memories (Hwang: the storage unit 19-30 may be configured with a plurality of memories) Thus, it would have been obvious to one skill in the art before the effective filing date of the claim invention to include the above recited limitation into Min’s invention in order to provide an improved method and apparatus for adding and changing cells, as taught by Hwang. 2. The method according to claim 1, wherein the first trigger condition comprises: that a current value of a timer is greater than a threshold of the timer when the terminal successfully accesses a first primary secondary cell; and/or wherein the first successful handover report comprises one of the following: related information of the primary secondary cell; related information of a primary cell accessed by the terminal and related information of the primary secondary cell accessed by the terminal; related information of a primary cell accessed by the terminal (MIN: [0075-0082, 0105]). 4. The method according to claim 2,wherein the related information of the primary secondary cell comprises one or more of the following: a report triggering reason; a cell identifier of a second primary secondary cell accessed by the terminal; a measurement result of a second primary secondary cell accessed by the terminal; a cell identifier of a first primary secondary cell accessed by the terminal; a measurement result of a first primary secondary cell accessed by the terminal; a measurement result of a neighboring cell of a first primary secondary cell accessed by the terminal; random access information of accessing a first primary secondary cell by the terminal; trigger node information in case of SN addition; trigger node information during change of the primary secondary cell; and/or, wherein generating the first successful handover report when determining that the first trigger condition is met comprises: when determining that the first trigger condition is met and when a second trigger condition of a successful handover report of the primary cell is met, recording related information of the primary cell; and generating the first successful handover report according to the related information of the primary cell (MIN: Handover related configuration…e.g., RACH with target cell; Candidate target cell ID…). 6. The method according to claim 4, wherein when determining that the first trigger condition is met and the second trigger condition of the successful handover report of the primary cell is met, recording the related information of the primary cell comprises one of the following: if time of determining that the second trigger condition is met is earlier than time of determining that the first trigger condition is met, then recording the related information of the primary cell; if time of determining that the first trigger condition is met is earlier than time of determining that the second trigger condition is met, then recording the related information of the primary secondary cell when the first trigger condition is met, and when the second trigger condition is met, recording the related information of the primary cell and deleting the related information of the primary secondary cell (MIN: T312 &/or T310). 7. The method according to claim 1, wherein after generating the first successful handover report, the method further comprises: sending first information to a first target network node, wherein the first information indicates that the terminal has generated the first successful handover report; the sending the first successful handover report to the first master node MN accessed by the terminal comprises: receiving a terminal information obtaining request message sent by a first MN; sending a response message to the first MN, wherein the response message comprises the first successful handover report (MIN: [0103] UE200 may send a Successful handover Report to the master node (MN) using ULInformationTransfer MRDC message). 8. The method according to claim 7, wherein the first information is carried by one or more of following messages: a radio resource control (RRC) connection establishment complete message; an RRC connection re-establishment complete message; an RRC connection reconfiguration complete message; an RRC connection resume complete message; and/or, wherein the sending the first information to the first target network node comprises one of the following: sending the first information to the first MN; if the change of the primary secondary cell is change of the primary secondary cell in the SN triggered by the SN, sending the first information to the SN; if the change of the primary secondary cell is change of the primary secondary cell in the MN triggered by the MN, sending the first information to the first MN (MIN: [0103] RRC Reconfiguration Complete ..). 10. The method according to any one of claims 7, wherein the first information is sent after the terminal successfully accesses a first primary secondary cell and generates the first successful handover report (MIN: [0103] UE200 may send a Successful handover Report to the master node (MN) using ULInformationTransfer MRDC message). 11. The method according to claim 1, wherein after generating the first successful handover report, the method further comprises: encoding the first successful handover report according to an access technology of accessing a first MN by the terminal; or encoding the first successful handover report according to an access technology of accessing a target SN by the terminal; wherein the access technology of the first MN is same as or different from the access technology of the target SN; and/or, wherein the method further comprises: receiving a conditional synchronization reconfiguration message, wherein the conditional synchronization reconfiguration message comprises a candidate primary secondary cell list and an execution condition corresponding to triggering the terminal to access a candidate primary secondary cell; performing the addition of the SN or the change of the primary secondary cell in a case that the execution condition is met (MIN: [0075-0082, 0105] reconfigurationWithSync). 13. The method according to claim 11,wherein the first successful handover report comprises one or more of the following information: the candidate primary secondary cell list; the execution condition corresponding to triggering the terminal to access the candidate primary secondary cell; time length information between first time and second time, the first time being time when the conditional synchronization reconfiguration message is received for last time before the execution condition is met, and the second time being time when determining that the execution condition is met; and/or, wherein the first successful handover report comprises: association information related to the first successful handover report; identification information, wherein the identification information is used to indicate that the addition of the SN or the change of the primary secondary cell is implemented through a conditional synchronization reconfiguration (MIN: [0075-0082] reconfigurationWithSync). Regarding claims 15, 20, 23, 30-31, 35, 38, 52-53, the independent claim and each dependent claim are related to the same limitation set for hereinabove in claims 1-2, 4, 6-8, 10-11, 13, where the difference used is an “apparatus” with a processor and a memory (Hwang: Referring to FIG. 19-20, includes a processor, a memory) and the wordings of the claims were interchanged within the claim itself or some of the claims were presented as a combination of two or more previously presented limitations. This change does not affect the limitation of the above treated claims. Adding these phrases to the claims arid interchanging the wording did not introduce new limitations to these claims. Therefore, these claims were rejected for similar reasons as stated above. 103 as being unpatentable over Min WO 2022044908 in view of Kumar US 11778527 1. Min merely discloses the memories Kumar further teaches the term memories (Kumar: fig. 6 - a processor and memory coupled with the processor may be configured) Thus, it would have been obvious to one skill in the art before the effective filing date of the claim invention to include the above recited limitation into Min’s invention in order to add or change serving cells, as taught by Kumar. 2.
