Claim Rejections - 35 USC § 103
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
Claim(s) 1-20 are rejected under 35 U.S.C. 103 as being unpatentable over Jianglin et al (CN 114801150)
Regarding claim 1-20, Jianglin (see claims 1-14, and description, paragraphs [0011]-[0063]) discloses a three-dimensional attaching and forming apparatus, comprising a thin film clamping fixture, wherein the thin film clamping fixture provides clamping of an optical thin film; a product fixture, which is arranged at a position corresponding to the thin film clamping fixture, and provides a curved surface product; and a profiling mechanism, which is arranged on the thin film clamping fixture and located at an initial position spaced apart by a distance from the optical thin film, wherein the profiling mechanism moves between the initial position and a pre-forming position for adjusting the shape of the optical thin film, a pressing surface of the profiling mechanism faces the upper surface of the optical thin film, the shape of the pressing surface corresponds to the shape of an attaching surface of the curved surface product, the profiling mechanism is provided with a plurality of airflow channels, and each airflow channel extends to the pressing surface to provide guiding of a barotropic gas to the upper surface of the optical thin film. The product fixture and the thin film clamping fixture are driven at an original position to move to an attaching position between the thin film clamping fixture and the product fixture, or are driven to leave the attaching position back to the original position. The shape of the pressing surface corresponds to the shape of the attaching surface of the curved surface product. The curvature of the pressing surface is less than the curvature of the attaching surface.
Jianglin further discloses a three-dimensional attaching and forming method, comprising the following steps: clamping an optical thin film by means of a thin film clamping fixture; placing a curved surface product on a product fixture; a profiling mechanism arranged above the thin film clamping fixture moving from an initial position spaced apart by a distance from the optical thin film to a pre-forming position, so that the optical thin film is adjusted by the profiling mechanism to form a pre-formed optical thin film; the thin film clamping fixture and the product fixture moving from the original position to the attaching position, at the same time, a plurality of airflow channels arranged in the profiling mechanism providing a barotropic gas according to the sequence of the lower surface of the optical thin film coming into contact with the attaching surface of the curved surface product, and uniformly attaching the optical thin film to the attaching surface; moving the profiling mechanism to the initial position again; and the thin film clamping fixture and the product fixture leaving the attaching position and moving to the original position.
However, Jianglin does not disclose a carrier mechanism comprises a carrier film and a clamping fixture, the carrier film is located between a pressing surface and a supporting surface, the side of the carrier film facing the pressing surface is used for fitting a second film to be attached, and the clamping fixture clamps the edge of the carrier film. However, it is the examiner’s position that for an attaching device for multiple layers of films, the described features are conventional components in the art, and a person skilled in the art would be able to select, according to requirements, whether to arrange a carrier mechanism.
