DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-5 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention -
In claim 1:
Claim 1 recites the limitations "the housing … the edge … the direct proximity … the conductors " in lines 1, 4 and 10-12. There are insufficient antecedent basis for these limitations in the claim.
It is unclear what “zero terminals” should refer to/mean in the claim.
The statement “and is connected through the conductors with phase A and neutral automatic shutdown mechanism in a single-phase variant or with any phase and neutral automatic shutdown mechanism in a three-phase variant” is unclear, it is unclear how a connection can be through the conductors with phase A and neutral automatic shutdown mechanism in a single-phase variant or with any phase and neutral automatic shutdown mechanism in a three-phase variant.
In claims 2-5:
The “as per item 1” is improper and renders the claims indefinite, since it is not clear if item 1 refers to the claim one or to an item in the claim one –
Under 35 U.S.C. §112(e) and 37 CFR §1.75(c), a dependent claim must:
Reference a claim previously set forth (independent or dependent).
Add a further limitation to that claim.
Incorporate by reference all limitations of the referenced claim.
The “is different” seems incomplete, and raises a question about what the thing which is different.
Claim 3 recites the limitation " the triggering … the external signal .. the contact group ". There is insufficient antecedent basis for this limitation in the claim. Further, the claim recites “a button (25)” twice, the second one should be changed to – the button – unless it is different from the button that mentioned first.
In claim 5, it is unclear what “DIN” stands for.
For the above reasons, claims 1-5 are considered indefinite.
Pertinent Arts
RU-209762-U1 - electrical terminals for connecting a neutral wire, a fire extinguishing aerosol generator module (4), which provides a zone of high temperature, an electric igniter extinguishing aerosol generator, and a temperature sensitive element with normally open contacts (6) and thermal fuses (5). The phase terminals are connected to each other through the thermal fuse. The first phase and zero terminals (2) are connected to the temperature-sensitive element with normally open contacts and an extinguishing aerosol generator electric igniter (7) connected to the extinguishing aerosol generator module when the thermal fuses are located in close proximity to the extinguishing aerosol generator module. Openings for an aerosol outlet are made in a side part of the housing, where response temperature of the temperature-sensitive element is lower than response temperature of the thermal fuses.
US 6625550 B1 – Column 7 teaches that Referring now to the drawings and initially to FIG. 1, there is shown in block form a novel arcing fault detector system in accordance with the invention, and designated generally by the reference numeral 10. An arcing fault is indicated diagrammatically at reference numeral 25. In the illustrative example, the arcing fault detection system 10 is associated with an aircraft electrical system such as a 115 volt, 400 Hz circuit 15 which is to be monitored for arcing faults; however, the invention is not limited to use with a 400 Hz circuit. At least one sensor 16 is provided in association with the circuit 15 for producing a signal representative of a signal condition, such as power, voltage or current in the circuit 15. In the illustrated embodiment, this sensor 16 comprises a current rate of change sensor (di/dt). A monitored conductor 15 of the circuit 15 passes through the rate of change (di/dt) current sensor 16 which produces a signal representative of the rate of change of current flow in the conductor 15. The airframe 14 provides a return path for the aircraft electrical system.
