Claim 1 is objected to because of the following informalities: claim 1 recites “traces all” in the second to last clause but this should be changed to “trace all”. Appropriate correction is required.
Claim Interpretation
The following is a quotation of 35 U.S.C. 112(f):
(f) Element in Claim for a Combination. – An element in a claim for a combination may be expressed as a means or step for performing a specified function without the recital of structure, material, or acts in support thereof, and such claim shall be construed to cover the corresponding structure, material, or acts described in the specification and equivalents thereof.
The following is a quotation of pre-AIA 35 U.S.C. 112, sixth paragraph:
An element in a claim for a combination may be expressed as a means or step for performing a specified function without the recital of structure, material, or acts in support thereof, and such claim shall be construed to cover the corresponding structure, material, or acts described in the specification and equivalents thereof.
The claims in this application are given their broadest reasonable interpretation using the plain meaning of the claim language in light of the specification as it would be understood by one of ordinary skill in the art. The broadest reasonable interpretation of a claim element (also commonly referred to as a claim limitation) is limited by the description in the specification when 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, is invoked.
As explained in MPEP § 2181, subsection I, claim limitations that meet the following three-prong test will be interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph:
(A) the claim limitation uses the term “means” or “step” or a term used as a substitute for “means” that is a generic placeholder (also called a nonce term or a non-structural term having no specific structural meaning) for performing the claimed function;
(B) the term “means” or “step” or the generic placeholder is modified by functional language, typically, but not always linked by the transition word “for” (e.g., “means for”) or another linking word or phrase, such as “configured to” or “so that”; and
(C) the term “means” or “step” or the generic placeholder is not modified by sufficient structure, material, or acts for performing the claimed function.
Use of the word “means” (or “step”) in a claim with functional language creates a rebuttable presumption that the claim limitation is to be treated in accordance with 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph. The presumption that the claim limitation is interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, is rebutted when the claim limitation recites sufficient structure, material, or acts to entirely perform the recited function.
Absence of the word “means” (or “step”) in a claim creates a rebuttable presumption that the claim limitation is not to be treated in accordance with 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph. The presumption that the claim limitation is not interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, is rebutted when the claim limitation recites function without reciting sufficient structure, material or acts to entirely perform the recited function.
Claim limitations in this application that use the word “means” (or “step”) are being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, except as otherwise indicated in an Office action. Examiner would like to point out that but for the interpretation of these elements under 112(f), a rejection under 101 would have issued.

Claims 1-7, 9-15, and 17-22 is/are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor, or for pre-AIA the applicant regards as the invention.
Claim 1 recites “generate a provisioning information based on comparison”. However, it is not clear whether comparison is referring to the compare introduced earlier in the same clause or some other comparison operation.
Independent claims 13, 21-22 have the same error and are rejected for the same reasons as claim 1.
The dependent claims inherit the limitations of their respective independent claims and are rejected for the same reasons as their respective independent claim.
Appropriate correction is required.
Claim Rejections - 35 USC § 103
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
The factual inquiries set forth in Graham v. John Deere Co., 383 U.S. 1, 148 USPQ 459 (1966), that are applied for establishing a background for determining obviousness under 35 U.S.C. 103 are summarized as follows:
1. Determining the scope and contents of the prior art.
2. Ascertaining the differences between the prior art and the claims at issue.
3. Resolving the level of ordinary skill in the pertinent art.
4. Considering objective evidence present in the application indicating obviousness or nonobviousness.
This application currently names joint inventors. In considering patentability of the claims the examiner presumes that the subject matter of the various claims was commonly owned as of the effective filing date of the claimed invention(s) absent any evidence to the contrary. Applicant is advised of the obligation under 37 CFR 1.56 to point out the inventor and effective filing dates of each claim that was not commonly owned as of the effective filing date of the later invention in order for the examiner to consider the applicability of 35 U.S.C. 102(b)(2)(C) for any potential 35 U.S.C. 102(a)(2) prior art against the later invention.
Claims 1-2, 5, 7, 12-15, 17, and 20-22 is/are rejected under 35 U.S.C. 103 as being unpatentable over Hoffpauir et al. U.S. Publication 20220377113 (hereinafter “Hoffpauir”) in view of Gauthier et al. U.S. Publication 20130303110 (hereinafter “Gauthier”), further in view of Attanasio et al. U.S. Publication 20130057388 (hereinafter “Attanasio”).

Gauthier also discloses delivering intercept data to authorities via an identified mediation and delivery function (MDF).[ return corresponding intercept data to the delivery function 22…… delivery function 22 then returns the intercept data to the requesting authority 18, para 12; identified mediation is disclosed because the intercept data is determined to be sent to the delivery function and the delivery function facilitates delivery to the requesting authority.

Gauthier [0012] In response to the intercept request from the administration function 20 of the communication intercept system 12, the ICEs 26 intercept communications to and from the wireless device 16-1 of the target user 24 and return corresponding intercept data to the delivery function 22 of the communication intercept system 12. The delivery function 22 then returns the intercept data to the requesting authority 18. The intercept data may include, for example, the content of a call to or from the wireless device 16-1 of the target user 24.
It would have been obvious to a person having ordinary skill in the art before the effective filing date of the claimed invention to have modified Hoffpauir with the technique for collecting short messages and extracting and comparing usage patterns of devices being monitored and forwarding intercept data to authorities via delivery function of Gauthier to include a short message service function (SMSF) configured to cooperate with said ADMF to receive said generated tracing request and is further configured to:
said CLIF coupled to said SMSF to receive said event, and is configured to:
extract a plurality of information from said received event;
compare said at least one user equipment (UE) identifier stored in said database corresponding to said tracing request with said extracted plurality of information and traces all related details of said target UE and at least one UE communicating with said target UE to generate a provisioning information based on comparison; and
transmit said generated provisioning information to a law enforcement monitoring facility (LEMF), via an identified mediation and delivery function (MDF).
One of ordinary skill in the art would have made this modification to improve the ability of the system to properly identify the device being traced and its messages from among data collected from a network, and provide a specialized mediation and delivery function to deliver intercept data to authorities. The system of the primary reference can be modified to collect more data to determine device usage patterns and to identify the device usage data based on the identifier of the device in order to properly provide the device message history to the authorities.

wherein said plurality of information includes at least one user equipment (UE) identifier of said target UE, at least one user equipment (UE) identifier of said at least one UE communicating with said target UE, message payload, location information, and public land mobile network (PLMN) information.
One of ordinary skill in the art would have made this modification to improve the ability of the system to extract and communicate location information and public land mobile network information from intercepted network usage data and provide such intercepted information to a receiving party, so that the receiving party can determine the whereabouts of the party being targeted.

Claim 9 is/are rejected under 35 U.S.C. 103 as being unpatentable over Hoffpauir in view of Gauthier, in view of Attanasio, further in view of Cartmell et al. U.S. Publication 20130326631 (hereinafter “Cartmell”).

One of ordinary skill in the art would have made this modification to improve the ability of the system to provide a specialized mediation and delivery function to deliver intercept data to authorities. The system of the primary reference can be modified to to properly provide the intercept data to the authorities via the specialized delivery component, so that all such delivery functions are customized at a single component for convenient management.
However, the combination of Hoffpauir, Gauthier, and Attanasio does not expressly disclose wherein said CLIF is configured to transmit said generated provisioning information to said identified mediation and delivery function (MDF) over a secured Transmission Control Protocol (TCP) connection.
Cartmell discloses transferring messages via TCP connection and detecting lost packets

One of ordinary skill in the art would have made this modification to improve the ability of the system to transmit the data over a TCP connection and detect lost packets. The system of the primary reference can be modified to transmit the intercept data to the delivery function over a secure TCP connection for forwarding to authorities.
As per claim 17, the claim(s) is/are directed to a method with limitations which correspond to limitations of claim 9, and is/are rejected for the reasons detailed with respect to claim 9.
Claims 10 and 18 is/are rejected under 35 U.S.C. 103 as being unpatentable over Hoffpauir in view of Gauthier, in view of Attanasio, further in view of Barese et al. U.S. Publication 20180213007 (hereinafter “Barese”).
As per claim 10, the rejection of claim 1 is incorporated herein.
However, the combination of Hoffpauir, Gauthier, and Attanasio does not expressly disclose wherein said CLIF is configured to retransmit said generated provisioning information after a predefined time interval if any delivery failure occurred.

The buffer arrangement 250 may comprise a great number of buffer storages providing enough storage capacity for storing regular communication traffic of plenty of intercepted targets.
It would have been obvious to a person having ordinary skill in the art before the effective filing date of the claimed invention to have modified the combination of Hoffpauir, Gauthier, and Attanasio with the technique for retransmitting communication contents due to loss of packets when delivering intercepted data to law enforcement of Barese to include wherein said CLIF is configured to retransmit said generated provisioning information after a predefined time interval if any delivery failure occurred.
One of ordinary skill in the art would have made this modification to improve the ability of the system to ensure that the intercepted data is fully transmitted to the law enforcement. The system of the primary reference can be modified to retransmit communication contents due to loss of packets when it is determined that the packets received are missing some packets at the law enforcement. after a predefined time interval is disclosed because the time interval is from beginning the delivery up to when the delivery is examined to determine whether it’s complete. The time interval is not necessarily constant but it’s predetermined according to their communication retransmission protocol.
As per claim 18, the claim(s) is/are directed to a method with limitations which correspond to limitations of claim 10, and is/are rejected for the reasons detailed with respect to claim 10.
Claims 11 and 19 is/are rejected under 35 U.S.C. 103 as being unpatentable over Hoffpauir in view of Gauthier, in view of Attanasio, further in view of Erol et al. U.S. Publication 20080220754 (hereinafter “Erol”).

In step 274 the administrator device 106 receives the copy of intercepted communications 272, and in step 275 the administrator device 106 stores the received intercepted communications. In step 276 the law enforcement node 116 generates and sends a request for content message 277 to the administrator device 106 requesting intercepted content corresponding to UE 1 118 target. Erol discloses duplicate copies of intercepted packets are sent to one or more Lawful interception Delivery Functions
[0011] Unlike prior art systems in which a dedicated device would need to carry a heavy load of traffic, as all media would be routed through it, the present invention completely avoids a costly new network element and utilizes existing media equipment. For the embodiment disclosed herein, Lawful Interception (LI) of mobile call contents is implemented directly on the Base Station Controllers (BSC) in the system via media forking. Using the method of the invention the BSC creates duplicate copies of any RTP packets incoming into and outgoing from any endpoint that is the target of Lawful Interception. The duplicate copies of these packets are then sent to one or more Lawful interception Delivery Functions (DF). The content and destination of the original copies of the packets is not altered in any way, so LI has no impact on the actual media streams.
It would have been obvious to a person having ordinary skill in the art before the effective filing date of the claimed invention to have modified the combination of Hoffpauir, Gauthier, and Attanasio with the technique for duplicate copies of intercepted packets are sent to one or more Lawful interception Delivery Functions of Erol to include

One of ordinary skill in the art would have made this modification to improve the ability of the system to send the intercepted packets to multiple mediation and delivery functions. The system of the primary reference can be modified to send intercepted data to multiple mediation and delivery functions, in case one of the mediation and delivery functions is not operating then the others can forward the intercepted data to law enforcement.
As per claim 19, the claim(s) is/are directed to a method with limitations which correspond to limitations of claim 11, and is/are rejected for the reasons detailed with respect to claim 11.
