Claim Rejections - 35 USC § 103
5. In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
6. The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
7. The factual inquiries for establishing a background for determining obviousness under 35 U.S.C. 103 are summarized as follows:
1. Determining the scope and contents of the prior art.
2. Ascertaining the differences between the prior art and the claims at issue.
3. Resolving the level of ordinary skill in the pertinent art.
4. Considering objective evidence present in the application indicating obviousness or nonobviousness.
8. Claim(s) 8 is rejected under 35 U.S.C. 103 as being unpatentable over Chinese Patent Publication 113744683 to Cheng et al (“Cheng”) (relied upon English translation) in view of U.S. Patent Publication 2021/0065624 to Li et al (“Li”).
As to Claim 8, Cheng depending from Claim 1, Cheng does not expressly disclose wherein the pixel circuit further comprises an auxiliary capacitor, a first electrode plate of the auxiliary capacitor is electrically connected with the second terminal of the driving circuit, and a second electrode plate of the auxiliary capacitor is electrically connected with a first reset signal voltage terminal. Li teaches wherein the pixel circuit further comprises an auxiliary capacitor, a first electrode plate of the auxiliary capacitor is electrically connected with the second terminal of the driving circuit, and a second electrode plate of the auxiliary capacitor is electrically connected with a first reset signal voltage terminal (the storage circuit 11 comprises a first capacitor C1. A first terminal of the first capacitor C1 is connected to a first power supply terminal V1 [first reset signal voltage terminal], a second terminal of the first capacitor C1 is connected to a first node S [second terminal of the driving circuit], and the data writing circuit 12 is also connected to the first node S, that is, the second terminal of the first capacitor C1 is connected to the data writing circuit 12, see ¶ 0045).
Before the effective filing date of the claimed invention, it would have been obvious to one of ordinary skill in the art to modify Cheng with Li to teach wherein the pixel circuit further comprises an auxiliary capacitor, a first electrode plate of the auxiliary capacitor is electrically connected with the second terminal of the driving circuit, and a second electrode plate of the auxiliary capacitor is electrically connected with a first reset signal voltage terminal. The suggestion/motivation would have been in order to write the compensation voltage to the compensation circuit according to the stored data voltage (see ¶ 0019).
Claim(s) 12-13 are rejected under 35 U.S.C. 103 as being unpatentable over Chinese Patent Publication 113744683 to Cheng et al (“Cheng”) (relied upon English translation) in view of U.S. Patent Publication 2022/0122522 to Li et al (“Li”).
As to Claim 12, Cheng depending from Claim 1, Cheng does not expressly disclose wherein the pixel circuit further comprises a third reset circuit, a control terminal of the third reset circuit is configured to receive a third reset control signal, a first terminal of the third reset circuit is electrically connected with the first terminal of the driving circuit, and a second terminal of the third reset circuit is electrically connected with a third reset signal terminal to receive the third reset signal, the third reset circuit is configured to apply the third reset signal to the first terminal of the driving circuit in response to the third reset signal. Li teaches wherein the pixel circuit further comprises a third reset circuit, a control terminal of the third reset circuit is configured to receive a third reset control signal, a first terminal of the third reset circuit is electrically connected with the first terminal of the driving circuit, and a second terminal of the third reset circuit is electrically connected with a third reset signal terminal to receive the third reset signal, the third reset circuit is configured to apply the third reset signal to the first terminal of the driving circuit in response to the third reset signal (the reset module 15 includes a fourth transistor T4. The first terminal of the fourth transistor T4 receives the reset signal Vini [second terminal of the third reset circuit receives a third reset signal]. The second terminal of the fourth transistor T4 is electrically connected to the second terminal of the driving transistor T0 [first terminal of the third reset circuit connected with first terminal of the driving circuit]. A gate of the fourth transistor T4 receives a third scan signal s2-p1 [third reset control signal], see ¶ 0072).
Before the effective filing date of the claimed invention, it would have been obvious to one of ordinary skill in the art to modify Cheng with Li to teach wherein the pixel circuit further comprises a third reset circuit, a control terminal of the third reset circuit is configured to receive a third reset control signal, a first terminal of the third reset circuit is electrically connected with the first terminal of the driving circuit, and a second terminal of the third reset circuit is electrically connected with a third reset signal terminal to receive the third reset signal, the third reset circuit is configured to apply the third reset signal to the first terminal of the driving circuit in response to the third reset signal. The suggestion/motivation would have been in order to write the compensation voltage to the compensation circuit according to the stored data voltage (see ¶ 0019).
As to Claim 13, Cheng and Li depending from Claim 12, Li teaches wherein the third reset circuit comprises a third reset transistor, a gate electrode of the third reset transistor is configured to receive a third reset control signal, a first electrode of the third reset transistor is electrically connected with the first electrode of the first compensation transistor and the first terminal of the driving circuit, and the first electrode of the third reset transistor is electrically connected with a third reset signal terminal to receive the third reset signal (the reset module 15 includes a fourth transistor T4. A gate of the fourth transistor T4 receives a third scan signal s2-p1 [third reset control signal], see ¶ 0072. Figure 2 illustrates the first electrode of the fourth transistor T4 connected to the first terminal of the driving transistor via node N3).
