DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim(s) 1-14 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Cho (KR101182225B1). Regarding claim 1, Cho discloses a fluid product dispenser comprising: a dispensing head (20) for dispensing the fluid product, a container (31) of the fluid product, a dispensing pump (33) attached to the dispensing head by an upper part (35) of the dispensing pump, an actuating part (32) attached to said container and capable of being displaced according to an axial displacement, and a cam ring (50) movable in rotation relative to the actuating part, the actuating part comprising first cam means (32a, 32b) cooperating with second cam means (52) of the cam ring so that the axial displacement is obtained by a transformation of a rotational movement of the actuating part with respect to the cam ring, the axial displacement allowing an actuation of the dispensing pump (par. 0031-0032). Regarding claim 2, the dispensing pump can be actuated from a lower part (36) of the dispensing pump. Regarding claim 3, the dispensing pump comprises a pump body (36) and a rod (34) axially movable relative to each other, the rod being connected to the pump body by a lower end (32) and attached to the dispensing head by an upper end (35) of the dispensing pump. Regarding claim 4, the rod has a full or partial stroke (Fig. 7a). Regarding claim 5, the pump body is wedged in abutment (Fig. 7a). Regarding claim 6, the rod is wedged in abutment (Fig. 7a). Regarding claim 7, the rod is held by friction to the dispensing head (Fig. 7a). Regarding claim 8, the cam ring is mounted on a receptacle (40, 60) of the dispenser. Regarding claim 9, the dispensing pump is wedged upwards before or when the dispenser is used for the first time (Fig. 7a). Regarding claim 10, the first cam means are cam followers (32a, 32b) configured to follow a trajectory (52) of the second cam means of the cam ring. Regarding claim 11, the cam followers are radial protrusions (32a, 32b) configured to follow the trajectory of the second cam means of the cam ring. Regarding claim 12, the cam ring (Figs. 2 and 6; par. 0024) comprises a cam trajectory (52) having at least two recesses (lower portion of 52 on both sides of 50) and two summits (upper portion of 52 on both sides of 50). Regarding claim 13, Cho discloses a rotary shrink ring (40) connected in rotation with the actuating part. Regarding claim 14, the cam ring comprises at least one first locking means (51) cooperating with at least one second locking means (42) of the rotary shrink ring so as to block the rotational movement of the actuating part with respect to the cam ring when the actuating part is in low rest position. Allowable Subject Matter Claim 15 is objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
