Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claim 20 is rejected under 35 U.S.C. 102(a)(2) as being anticipated by Maamari et al. (U.S. Patent No. 12,068,929 B1, hereinafter Maamari).
.
Regarding claim 20 , Claim 20 recites network equipment for wireless communication with at least one memory and a processor coupled to the memory. Maamari teaches network node 110 communicating with UE 120 (Fig. 4 and its description) and expressly identifies controller/processor 240 and memory 242 of network node 110 (Fig. 2 and its description). The disclosed node therefore supplies the recited apparatus and processing structure.
Determining the logical channel priority. Claim 20 requires the network equipment to determine a logical channel priority for a logical channel. Maamari teaches that network node 110 determines priorities for respective LCHs in Fig. 4, operation 410. The same example assigns priorities 1, 2, and 3 to LCHs 1, 2, and 3 in the description of Fig. 4, operation 420.
Transmitting the configuration. Claim 20 requires the network equipment to transmit a configuration for establishing the LCH with the UE, the configuration comprising the LCH priority. Maamari teaches that network node 110 transmits LCH configuration information to UE 120 in Fig. 4, operation 415. The description of that operation specifies a LogicalChannelConfig RRC parameter and states that the LCH configuration indicates an LCH priority. See also the Fig. 6 description of operation 615, which identifies LCH configurations and their priority values. Configuring the LCH for the UE meets the recited configuration for establishing the channel.
Receiving data based on the priority. Claim 20 requires the network equipment to receive data on the LCH from the UE based on the LCH priority. In Fig. 4, operation 420, Maamari teaches that UE 120 selects data for uplink transmission according to the priorities of the configured LCHs; in operation 425, the UE transmits the selected data using the LCHs. The description of Fig. 6, operation 625, expressly states that network node 110 receives uplink data via configured LCHs. Thus, the received data is selected for transmission based on the LCH priority supplied in the configuration.
Claim 20 does not recite the conditional calculation of a new data priority value required by independent claims 1, 18, and 19. The Fig. 4 priority configuration and uplink selection and the Fig. 6 network receipt are teachings of the same Maamari patent and support the rejection of claim 20 as written.
Allowable Subject Matter
Claims 1–19 are allowable over the art of record. Independent claims 1, 18, and 19 recite a conditional calculation of a data priority value from first and second data parameters and the configured LCH priority when the first parameter is below a threshold. The art considered does not establish that combination. Claims 2–17 depend from claim 1 and include the limitation. This statement does not limit the claims to the feature discussed.
